Reddit Suspended My Account for Child Safety Content: Is There a Report??

A Reddit-style child safety suspension can be the first sign that you have been reported to law enforcement and are under investigation. While a Reddit child safety suspension does not prove that Reddit filed a CyberTipline report, it does prove that Reddit has reason to think that you violated its child safety policies. In most cases, this means that you have been reported to the NCMEC CyberTipline and a corresponding report exists.

A platform account ban is not the same thing as the close of a case. Even if your account is suspended, you could still be under investigation by the Federal Bureau of Investigation (FBI), the Department of Homeland Security (DHS), Homeland Security Investigations (HSI), or similar law enforcement authorities. Similarly, if weeks (or months) have passed without any questions or concerns from law enforcement, this does not prove that investigators have moved on. To the contrary, federal investigators often work in silence and do not make themselves known until they are prepared to pursue charges.

A CyberTipline report can be generated in many situations other than reporting to a social media company. Examples of how law enforcement finds out about CSAM reports and discoveries include:

• Computer repair technicians, If a computer repair technician finds evidence of CSAM during the course of repairing a customer’s device, a minority of states, including Texas, North Carolina, Illinois, Missouri, Oklahoma, South Carolina, Arkansas, and South Dakota, require the technician to report the discovery to state or local law enforcement or to the NCMEC CyberTipline, although federal law imposes no such duty on repair technicians.
• Witnessing, If someone sees a picture on your phone or laptop, this can lead to the generation of a report.
• Unrelated searches, A search warrant for unrelated matters (e.g., drug offenses) can lead to the discovery of CSAM and generate a new report.
• Other reasons

These examples show that many different circumstances can lead to CSAM reports and law enforcement investigations.

Does Reddit Always Report Child Safety Suspensions to NCMEC?

According to 18 U.S.C. § 2258A(b)(2), all providers “that are in the United States and do business in the United States” are required to promptly report to the National Center for Missing and Exploited Children (NCMEC) images of what appears to be child sexual abuse material (CSAM). The statute applies to a “provider,” a term defined by reference to an electronic communication service provider or remote computing service provider:

• Social Media and Messaging Services
• Email Services
• Search Services
• Cloud Storage and Computation Services

These are, among others, the most prominent examples of providers subject to mandatory reporting obligations. Reddit falls into this category, as does any other website, app, or platform that provides these services. However, a Reddit suspension for child safety content is not the same thing as a CyberTipline report; nor is a Reddit child safety suspension an admission that you are at risk of being charged with violating federal child pornography laws.

How When Do Reporting Obligations Trigger?

Under 18 U.S.C. § 2258A(b)(2), providers have a mandatory duty to report any actual or suspected instances of “child pornography” to NCMEC once they acquire “qualifying knowledge” of such material. The definition of “qualifying knowledge” is a key legal issue. If Reddit suspends you based on content that qualifies for child safety-related protection on Reddit, but doesn’t constitute child pornography as defined by federal law, it may have no reporting obligation.

Under the CSAM statutes, materials that are prohibited as CSAM include, among others, visual depictions of sexual violence; materials that are sexually explicit; and materials that depict sexual abuse. But this list is not exhaustive. While the CSAM statutes are broad in scope, they are still limited to material that contains a sexual depiction. As a result, there is a possibility that Reddit may have suspended you based on child safety-related content that is otherwise not prohibited as CSAM under federal law. An example is nonsexual child nudity, which is not automatically considered to be child pornography.

As a result, in order to determine whether you are at risk of being charged with violating federal child pornography laws after a Reddit child safety suspension, it is important to examine the content that led to your suspension and see how it fits into the statutory definition of child pornography.

Does Reddit Have to Scan My Private Messages or Files?

A critical distinction between private files and public-facing platforms is that, under 18 U.S.C. § 2258A, platforms like Reddit do not have a general duty to proactively scan their users’ private files or messages. If you are accused of providing, soliciting, or distributing CSAM through Reddit’s private-messaging feature, this can trigger Reddit’s reporting obligations, but only if Reddit receives “qualifying knowledge” of the illegal conduct.

In many cases, “qualifying knowledge” comes in the form of reports from ordinary Reddit users. However, a report from an ordinary Reddit user is not the same thing as a CyberTipline report to NCMEC. While these user reports often trigger investigations by Reddit’s Trust and Safety team, and an internal Trust and Safety referral may trigger a CyberTipline report to NCMEC, there are various stages in between. These are important stages that we must be able to analyze with a proper understanding of the law and the facts involved.

Can I Find Out Whether Reddit Filed a CyberTipline Report?

When a platform files a CyberTipline report, this usually happens before any user is alerted to the possibility that Reddit is investigating their account or files. Similarly, while 18 U.S.C. § 2258A requires reporting to NCMEC in the event of apparent child sexual abuse material (CSAM), it does not impose a duty to notify the reported user. As a result, you will typically not know whether (or when) Reddit makes a CyberTipline report to NCMEC unless you learn about it through some other means.

Can I Get a Copy of a CyberTipline Report?

Generally, an ordinary user cannot demand a copy of a CyberTipline report from NCMEC. If you have been reported to the NCMEC CyberTipline, you will have to wait to find out whether this report triggers a criminal investigation and leads to criminal charges. However, as a defendant in a CSAM case, you can seek access to information you are entitled to as part of the criminal discovery process. Once you have been charged with a child pornography crime, information in the CyberTipline report may be disclosed to you or your attorney, subject to 18 U.S.C. § 3509(m) and the statutory limits on disclosure.

What Information is Contained in a CyberTipline Report?

CyberTipline reports typically contain a broad range of information collected by the platforms that file them. This information may include, among others, the following:

• The IP Address that is associated with the image, video, or communication at issue
• The Image Hash (if an image, video, or communication hash is available)
• A Description of the Image, Video, or Communication
• User Account Information (name, email address, and other identifying information)

The specific information that is included in a CyberTipline report will depend on the platform that files the report, the type of material being reported, and the nature of any available IP or account-related information.

After reviewing a report, NCMEC makes it available to one or more federal, state, local, or designated foreign law-enforcement agencies involved in investigating child-exploitation crimes. In most cases, NCMEC uses the IP address(es) associated with the reported material to determine which agency has jurisdiction, and then uses the account information to help the agency conduct its investigation.

How Long Will Reddit Preserve My Information?

Under the REPORT Act of 2024, providers are required to preserve the contents of a CyberTipline report for at least one year after the report is submitted to the CyberTipline. This means that providers must preserve any pertinent information (including data that may contain CSAM) for at least one year, even if an ordinary user account is suspended.

While this data remains preserved by the platform, federal investigators have ample time to seek the legal process necessary to compel the platform to produce the preserved data for the agency’s investigation. As a result, a Reddit child safety suspension does not necessarily mean that you will not face legal trouble.

What Happens After NCMEC Receives a Report from Reddit?

A CyberTipline report is an investigative lead, not a conviction. After NCMEC receives a report from Reddit (or any other platform), it must review the report and determine its priority. If the report involves the suspected distribution of CSAM or evidence of other urgent child safety issues, it will be flagged as a high priority. NCMEC then forwards the report to the appropriate federal, state, or local law enforcement agency. In most cases, this includes a report to the Department of Homeland Security (DHS), the Federal Bureau of Investigation (FBI), or the Internet Crimes Against Children Task Force (ICAC) located in the appropriate jurisdiction.

Upon receipt of the CyberTipline report, law enforcement personnel use the information in the report (such as IP address or other account information) to identify the potential child pornography offender. In most cases, federal investigators use the information in the CyberTipline report to establish where the account is located and the identity of the account holder.

Once law enforcement personnel establish the location and identity of the account holder, federal investigators can use various forms of legal process to gather additional information. For example, federal investigators can issue a grand jury subpoena to any Internet Service Provider (ISP) that has evidence of the account holder’s identity and account details in its subscriber records. Federal investigators can also seek warrants for seized computers, mobile devices, cloud-stored data, and search and seizure warrants for law enforcement to conduct searches for prohibited materials.

To obtain a federal search warrant, investigators must submit an affidavit or other information establishing probable cause to a magistrate judge; that submission may include a CyberTipline report. The report must show probable cause that the target of the warrant possesses child pornography or is engaging in other illegal activity. While a CyberTipline report is a crucial step in establishing probable cause, the report by itself is not enough to obtain a warrant. In order to obtain a warrant, federal investigators must first establish probable cause to search the target’s device or cloud-stored account.

How Long Does it Take for Law Enforcement to Get a Search Warrant?

The time it takes for federal investigators to obtain a search warrant after receiving a CyberTipline report can range from a few days to several months. In most cases, this time is spent establishing probable cause that will support the judge signing the search warrant. Once federal investigators have established probable cause, the search warrant will be served to the appropriate entity, such as Reddit.

If the account is located outside of the United States, NCMEC may refer the report to law enforcement personnel in the appropriate foreign jurisdiction.

Can an Account or IP Address Prove that it Was Me?

An account holder, IP subscriber, device owner, and actual user are four different identities. While investigators may have evidence that a certain IP address was used to post content that was prohibited, this does not necessarily show who the person behind the screen was.

In today’s world, there are many different reasons why a person who is responsible for the actual upload of a picture or video may not be the account holder or IP subscriber. Some common reasons why you may not be responsible for prohibited content posted to Reddit include:

• You use a VPN or other IP-masking device.
• You use a dynamic IP address.
• Someone else accessed your account using your login credentials.
• You shared a password with another user.

A device owner may not be the device user, either. For example, if a roommate, family member, or guest in your home used your wireless router or your computer or tablet, this information would lead investigators to you even if you were not the one who posted the illegal content. As a result, when the government targets your IP address, a criminal investigation will often fail to identify the individual responsible for the posting or hosting of child pornography.

Even if federal investigators are able to use your IP address to determine your identity, they must then use this information to identify your device. Once federal investigators execute a search warrant to seize your devices, they can then use various types of forensic tools to identify evidence of illegal activity. This includes the use of search histories, file-sharing software, files stored in your cloud services, and private messages.

Even so, once federal investigators find prohibited material on your devices, this information does not, in itself, prove you are the one who posted the material or the one who owns the material. To prove you are guilty of violating a criminal statute, the government must prove that you knowingly possessed the material and that you were the one who posted, distributed, or sold the material. If you can demonstrate that you did not have knowing possession of the material, this can be a viable defense to your CSAM investigation.

What is Hash-Matching?

Hash-matching is a type of forensic tool used to identify child sexual abuse material (CSAM) on the internet. A hash is a unique digital fingerprint of a file. Once an image is flagged as containing CSAM, its hash is added to a database of known CSAM images. Now, instead of having to review a file manually to determine if it contains CSAM, computers can automatically identify known CSAM based on a hash match. This is how automated reporting systems, such as Reddit’s reporting system, work. While hash-matching is a powerful tool for identify, this tool is still subject to forensic and chain-of-custody challenges. If a platform or law enforcement agency uses a hash-match to identify CSAM, it may still be necessary to obtain a forensic image of the relevant file and to challenge the hash’s integrity or the chain-of-custody.

Does NCMEC Have a Success Rate for CyberTipline Reports?

According to NCMEC’s 2024 numbers, the organization received a total of 20.5 million reports (including 17.3 million from U.S.-based sources and 3.2 million from foreign-based sources). NCMEC’s numbers show that 84% of all report locations were outside the United States. The reports also show that five electronic service providers (Apple, Google, Meta, Microsoft, and others) generated 91% of all CyberTipline reports. However, when comparing total reports to the number of prosecutions or convictions, it is easy to arrive at the conclusion that most reports do not result in criminal charges.

The problem with comparing the total number of CyberTipline reports to the number of prosecutions is that the data are not linked. As a result, it is difficult to determine why cases did not proceed beyond the reporting stage. Moreover, NCMEC publishes statistics regarding reports, not their specific outcomes (i.e., convictions). Because of this, comparing total reports to convictions is not a reliable way of measuring how likely it is that a report will lead to prosecution.

Another interesting number is the number of entities that reported content to NCMEC. According to NCMEC, over 1,600 providers are registered to submit reports to the CyberTipline. However, just 245 providers reportedly submitted one or more reports during the relevant period. This means that most companies that have signed up to support efforts to curb CSAM distribution on the internet are not actually reporting suspected crimes to law enforcement. This is a great-sounding statistic for someone under investigation, but as we know, it should not be taken at face value. If one of those 245 providers is your device provider, internet service provider, or the social media platform you were using, then these statistics are irrelevant to you.

What Should I Do While Nothing is Happening?

If you suspect you may be under investigation, the most important thing you can do is avoid making the situation worse by doing something that exposes you to additional legal liability.

For example, while it may be tempting to delete all your files if you think you may be under investigation for child pornography, this can create separate legal exposure. First, if you delete files that federal investigators can later prove existed, you may face charges for obstruction of justice or spoliation of evidence. Second, if the files existed, you can still be charged with possessing or distributing child pornography.

This means that deleting suspected child pornography does not protect you from facing federal child pornography charges if federal investigators find evidence of the file in your hash-logs, metadata, or other forms of metadata. That is because, while deleting suspected child pornography may remove the evidence from plain view, it does not always remove it from forensic view. Even though this might happen in some cases, federal investigators are generally able to identify what files existed on a suspect’s device, and, if they can recover the files and demonstrate that they showed child pornography, the evidence of possession will be admissible.

Finally, when deleting content from a computer or other electronic device, a user does not necessarily destroy that content permanently, but instead deletes pointers to the content. Forensic tools can often recover the content and demonstrate that it still exists.

How Do I Avoid a Search?

You have the right to refuse consent for an investigation. But once law enforcement personnel have a search warrant, this right does not give you the ability to obstruct the warrant’s execution. You cannot hide your devices, destroy evidence, or prevent the seizure by any other means. And if you try to obstruct the execution of a valid search warrant, this can expose you to criminal charges.

During a search, federal agents are authorized to seize all devices that could store or transmit digital files. This includes, but is not limited to:

• Phones
• Computers
• External hard drives
• Game consoles
• Routers
• Smart TVs
• Smart home assistants
• Cloud storage
• Cloud computing services

Can Federal Prosecutors Charge Me for Possession of Child Pornography?

Yes, if you stored content or allowed other users to access content through your device or wireless network, you can be charged with federal possession of child pornography under 18 U.S.C. § 2252. Federal possession is a felony that carries a statutory maximum sentence of ten years.
