An SBA audit is an assessment of compliance with the program rules and regulations, whereas a criminal investigation or civil False Claims Act case is an assessment of a borrower’s liability for fraud. If a criminal investigation is needed, it is often a result of an initial SBA audit. Likewise, an SBA audit can trigger a civil fraud case under the False Claims Act.

When interpreting Idaho PPP loan fraud statistics, it is important to distinguish between federal investigations, indictments, guilty pleas, trials, convictions, and sentences.   • 18 U.S.C. § 1014, Loan and credit applications generally; renewals and discounts; crop insurance, This provision prohibits knowingly making a false statement or report, or willfully overvaluing property or security, to influence specified institutions and agencies-including the SBA and FDIC-insured institutions-in connection with a loan or related transaction. This is the statute that federal investigators and prosecutors rely upon to pursue charges of PPP loan fraud in Idaho federal court, and it is also the statute they rely on to pursue criminal charges against borrowers who improperly certify forgiveness applications.

When Can Repaying an Idaho PPP Loan Still Leave a Criminal or Civil Exposure?

If you are under investigation or under accusation of PPP loan fraud in Idaho, repayment does not automatically eliminate your potential for criminal liability. In most cases, repaying the loan is a voluntary act on your part that does not remove potential culpability; if you knowingly made false or fraudulent certifications to the federal government, a repayment may mitigate the government’s intent to prosecute, but repayment does not automatically remove your liability.

In federal cases, government prosecutors calculate loss, or any other relevant factors, based on the assumptions that the prosecution believes they can prove beyond a reasonable doubt in federal court.

The amount of loss is a critical factor when federal prosecutors calculate a sentence under the Federal Sentencing Guidelines. These guidelines generally use U.S. Sentencing Guidelines § 2B1.1 in the calculation, and it can be a subject of dispute in a federal case. Repayment of the funds obtained through the government program is generally not taken into account when determining if the funds were obtained through a fraudulent or deceptive scheme. Even if the federal government considers repayment sufficient, you still run the risk of criminal and civil liability. This means that repaying the loan does not remove potential criminal liability, and repayment also does not clear the issue of repayment of the loan to the federal government; the issue of repayment is a separate matter in addition to the potential for civil and criminal liability.

The False Claims Act allows for civil recovery for knowingly making, using, or causing to be made or used a false record or statement material to a false or fraudulent claim. The False Claims Act can also impose treble damages and civil penalties for such fraudulent attempts and can expose you for PPP loan fraud.
