How Doctors Lose Their Licenses – It Happens More Than You Think
A physician can lose his or her license in countless ways. Commonly, they’re charged with:
- Incompetence
- Criminal convictions
- Gross negligence
- Substance abuse
- Fraudulent practice
- Immoral conduct
States regulate all licensure issues. In New York, where we work, the New York Education Law controls physicians’ licensure and professional discipline – administered by the Office of Professional Medical Conduct (OPMC). These guys don’t mess around.
A doctor accused of misconduct could lose their medical license by either surrendering it or having the licensing agency revoke it. No matter how the physician lost their license, they must put in an application for license reinstatement before they can regain it – which is exactly what we help with.
License Suspension Versus License Revocation – There’s a Big Difference
Suspension removes medical license privileges temporarily – anywhere between a week to a year. You may have to surrender your actual physical license to the state board office, and you cannot legally practice your vocation until after the suspension is lifted or terminated and your license returned.
Though your license is automatically restored to you after the suspension is over, license revocation lasts indefinitely – until certain conditions are fulfilled:
- Paying fines
- Completing drug screening
- Obtaining insurance
- Whatever else the board decides you need to do
This is where it gets complicated, and where most doctors make mistakes that cost them years of their career.
How Spodek Law Group Handles Your Reinstatement
We assist our clients in deciding whether or not they can get medical license restoration. Here’s what we actually do:
- Evaluate and review their cases per statutory requirements
- Fill out applications for license restoration (and trust me, these aren’t simple forms)
- Send out necessary documentation to relevant persons and offices
- Follow up on medical license restoration to make sure applications are sent to state boards and processed on time
We consistently and regularly talk with our clients about the status of their medical license restoration. Our medical license attorneys commit to keeping our clients’ records confidential – because the last thing you need is your business on the street.
Our BBB (Better Business Bureau) A+ ratings testify to the quality of our services. We’re committed to quality. But more than that – we’re committed to getting your license back.
The OPMC Process – What You’re Up Against
The New York State Health Department’s Office of Professional Medical Conduct (OPMC) and the state Board for Professional Medical Conduct handle all this. Every year, the OPMC receives thousands of complaints from the public, health care professionals, and institutions. They investigate every single one.
Here’s how the process works:
Complaints submitted to OPMC are reviewed and assigned quickly. If you’re under investigation, you’re expected to help – you must make your records available. Failure to cooperate is considered misconduct according to New York State Education Law. That’s right – not cooperating is itself misconduct.
You’re permitted to have an attorney with you during any interview or at any stage of the investigation. And you absolutely should. Don’t try to handle this yourself.
If there’s not enough evidence to suggest misconduct, the investigation is terminated. But if an investigation shows evidence of misconduct? The case goes to an investigative committee. If the committee feels you’re an imminent threat to the public, they may recommend your medical license be suspended immediately. Charges are filed, a hearing is scheduled, and your career hangs in the balance.
Public Information – Your Reputation Is on the Line
It’s important for physicians to know that all final disciplinary actions and suspensions are public information. When charges are filed against you, they become public information once you’re served.
The information associated with previously closed complaints, dismissed actions, and ongoing investigations is kept confidential. The names and identities of complainants are also confidential. But once action is taken? Everyone knows.
This is why you need attorneys who understand not just the legal process – but the damage control needed to protect your reputation. At Spodek Law Group, we’ve handled high-profile cases. Remember our client Anna Delvey whose case became a Netflix series? We know how to handle public scrutiny.
Misconduct Penalties – They Have All the Power
The board has been given authority by New York state to take specific actions regarding a physician’s license:
- Various suspensions (partial, actual, fixed periods)
- License limitations
- Required education and training
- Fines
- Community service
- Censure or reprimand
- License annulment
- License revocation
They hold all the cards. You need someone who knows how to play the game.
License Revocation – It’s Not the End
Even when a physician has had their medical license revoked, there are opportunities to have it reinstated. You can reapply for your medical license three years after it’s been revoked. There’s no way around this waiting period – trust me, we’ve tried.
The first step is getting a copy of the medical license restoration application. They’re available online, but here’s the catch – the application must be from the New York Department of Education, NOT the New York Department of Health. Get this wrong, and you’ve wasted months.
You need five witnesses. Three must be physicians. All five can be physicians if you want. You need five affidavits explaining why you should be permitted to get your license back. These aren’t just character references – they need to be compelling arguments for your reinstatement.
The Main Hearing Questions – Be Prepared
There are two fundamental questions you’ll be asked during the reinstatement process:
1. Why should you be reinstated? Good answers involve how important being a physician is to you. Explain how you’ve corrected your problems and want to once again be a good member of the medical community. But it needs to be genuine – they’ve heard all the BS before.
2. What will you do if reinstated? This is crucial. If you have a witness offering to take you into their medical practice – that helps enormously. Having a job offer from a respected institution can make the difference between success and failure.
The Hearing – This Is Your Shot
After the application for reinstatement is properly completed and submitted, a hearing will be scheduled – usually within six months to a year after the application is received.
When you go to this hearing, you need an attorney who can guide you through the process. This isn’t the time to save money on legal fees.
At the hearing:
- You’ll have an opportunity to testify
- Your witnesses will testify why you should have your license reinstated
- A court reporter records everything
- The Board for Professional Medical Conduct will have a prosecutor
- Your lawyer can question witnesses
- The board’s prosecutor will cross-examine your witnesses
- The board can produce their own witnesses
- You can provide documents to help make your case
The burden of proof is on YOU. You have to prove you deserve reinstatement.
Both your lawyer and the board’s prosecutor will give opening and closing statements. This is where having an experienced attorney matters – someone who’s done this before, who knows what works and what doesn’t.
The Decision – And What Happens Next
When the hearing concludes, the board issues its recommendation. This recommendation goes to you, your attorney, and the Committee on the Professions – where your Application for Restoration is formally considered.
This is a long, grueling process. It’s emotionally draining, professionally devastating, and financially costly. But it doesn’t have to be impossible.
