THE BEST LAWYER ANYONE COULD ASK FOR.

The BEST LAWYER ANYONE COULD ASK FOR!!! Todd changed our lives! He’s not JUST a lawyer representing us for a case. Todd and his office have become Family. When we entered his office in August of 2022, we entered with such anxiety, uncertainty, and so much stress. Honestly we were very lost. My husband and I felt alone. How could a lawyer who didn’t know us, know our family, know our background represents us, When this could change our lives for the next 5-7years that my husband was facing in Federal jail. By the time our free consultation was over with Todd, we left his office at ease. All our questions were answered and we had a sense of relief.

Vocational Nurse or Psychiatric Technician License Defense Lawyers

Having your nursing or psychiatric technician license investigated or facing potential discipline can be an incredibly stressful and frightening experience. Your livelihood and career are on the line. But you don’t have to go through it alone. Having an experienced lawyer on your side can make all the difference.

In this article, we’ll provide an overview of the license defense process and how an attorney can help. We’ll also discuss some common reasons licenses get investigated, as well as potential penalties. Our goal is to educate and empower you so that you know your rights and options if your license is at risk.

The License Investigation and Discipline Process

In California, the Board of Vocational Nursing and Psychiatric Technicians (BVNPT) oversees licensing and discipline for vocational nurses, psychiatric technicians, and vocational nursing and psychiatric technician programs. If the BVNPT receives a complaint or otherwise becomes aware of potential misconduct, they may open an investigation. Investigations can lead to formal discipline if the Board determines there are grounds.

There are several steps in the discipline process:

  • Complaint and Investigation – The Board receives a complaint, or otherwise obtains information that may warrant an investigation. An investigator is assigned to gather facts.
  • Statement of Issues – If the investigation yields sufficient evidence, the Board may issue a Statement of Issues, which is essentially a charging document detailing the allegations.
  • Accusation – If settlement is not reached after the Statement of Issues, the Board files a formal Accusation. This initiates the disciplinary hearing process.
  • Administrative Hearing – An administrative law judge hears the evidence and makes a proposed decision if the Accusation should be sustained. You have the right to present a defense.
  • Board Decision – The Board reviews the proposed decision and can adopt, non-adopt, or modify it. At this point, the Board will impose discipline if the Accusation is sustained.
  • Appeal – You can appeal the Board’s decision to the superior court, then court of appeal and California Supreme Court.

This entire process can take many months or even years. Having an attorney ensures your rights are protected every step of the way.

How Can a License Defense Lawyer Help?

An experienced license defense lawyer can provide invaluable assistance if your license is under investigation or facing discipline. Here are some of the key ways we help our clients:

  • Guiding You Through the Process – The discipline process can seem overwhelming. We’ll break it down into understandable steps and provide expert guidance at each phase.
  • Conducting an Independent Investigation – We’ll thoroughly investigate the allegations and collect evidence, witnesses statements, and documents to build the strongest defense.
  • Negotiating with the Board – We’ll work to negotiate a fair settlement when possible to minimize discipline. If settlement talks fail, we’ll vigorously defend at hearing.
  • Presenting Your Defense – At the administrative hearing, we’ll present your defense, cross-examine witnesses, object to evidence, and fight to get the charges dismissed or reduced.
  • Appealing if Necessary – If the outcome is unfavorable, we’ll advise you on grounds for appeal and represent you through the appeal process.
  • Guiding You Through Compliance – If discipline is imposed, we’ll make sure you understand and comply with probation terms, reinstatement requirements, etc.

Having an experienced lawyer levels the playing field and ensures your rights and interests are fully protected.

Common Reasons Nursing Licenses Get Investigated

There are many reasons the BVNPT may investigate a nursing or psychiatric technician license. Some of the most common include:

  • Criminal Convictions – Convictions for drug or alcohol offenses, sex crimes, financial crimes, and crimes of violence may trigger an investigation. Even arrests without conviction may prompt the Board to take action.
  • Substance Abuse – Issues with drug or alcohol abuse, whether in the nurse’s personal life or on the job, often lead to complaints and investigations.
  • Negligence or Incompetence – Repeated medical errors, failing to follow standards of care, practicing beyond your scope, and harming patients are all grounds for discipline.
  • Sexual Misconduct – Engaging in inappropriate conduct with patients, even consentual, will lead to severe discipline.
  • Fraud – Fraudulent billing practices, falsifying records, identity theft, and insurance fraud may warrant investigation.
  • Unprofessional Conduct – Rude behavior, offensive comments, breaches of confidentiality, and other unprofessional acts expose a license to discipline.

Even one complaint doesn’t necessarily mean your license is in jeopardy. But multiple complaints on similar grounds will get the Board’s attention. An experienced lawyer can help determine if a complaint is something to be concerned about.

Potential Penalties and Consequences

If discipline is imposed, some potential penalties from the BVNPT include:

  • License Probation
  • License Suspension
  • License Revocation or Denial of Renewal
  • Fines and Cost Recovery
  • Practice Restrictions
  • Education Course Requirements
  • Supervised Practice
  • Mental Health Evaluations
  • Community Service

Even probation and suspensions can be devastating. You may lose your job, reputation, and ability to work in your chosen profession. Permanent revocation is the worst case scenario. An experienced lawyer will fight to avoid revocation and minimize any discipline imposed.
