The Importance of Registering as a Sex Offender

Sexual assault is an abhorrent and distressing crime that leaves permanent scars on victims. To prevent this, sex offenders are legally required to register with the appropriate law enforcement agency once they are released into the public. In doing so, registration aims to protect communities, help apprehend suspects and discourage further criminal acts. If left unaddressed, sexual offenses have far-reaching consequences on society.

History of Sex Offender Registration Laws

Since Congress started focusing heavily on sex offender registration laws in 1994, the need for regulation has become increasingly apparent. It was then that The Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act passed, establishing standards for state registration of sex offenders.

Megan’s Law and several other bills followed throughout the next decade before The Sex Offender Registration and Notification Act (SORNA) was enacted in 2006. SORNA established a federal standard for registering sex offenders by classifying sexual offenses into different tiers based on various factors such as location, offense type or severity. Each tier comes with different reporting requirements:

Sex offender registration is enforced in all 50 states, the District of Columbia, and some Native American tribal jurisdictions as well as five principal US Territories. Although sex offender registration specifics vary from state to state, jurisdictions are mandated to uphold a minimum standard. This means that while they can enact more stringent laws compared to the federal standard, they cannot request for less than SORNA’s requirement. As a result, local sex offender laws and penalties may top those stipulated by the federal government.

What Happens if You Fail to Register as a Sex Offender?

If you have been convicted as a sex offender, failure to register is considered a federal offence. When an offender plans on changing towns, schools or employers; they must notify law enforcement in person so that relevant data can be updated accordingly. If the said registrant fails to do so when moving between different jurisdictions, they will become subject to state/federal criminal penalties.

Specifically for failure to comply with federal registration requirements,SORNA sets forth financial penalties along with up-to 10 years imprisonment.   7. Furthermore, Registrants must notify registering sheriff officials when they enroll/terminate enrollment in any educational institution.
  8. By complying with the sex offender registration requirements, you will not only follow the law but may also secure a more lenient schedule as part of your probation terms. Some states provide leeway allowing offenders to appeal penalties after a reputation of successful registration throughout several years as well as fulfilling beforehand assorted prerequisites such as therapy.
