It offers limited immunity. In the 1950’s the government wanted information from people. It created transactional immunity. If you can’t be prosecuted for the transaction, that you provided information for. It meant lots of murderers didn’t get charged with murder due to the immunity offered. This immunity prevents indirect, and direct, use of information the informant provides. In an CFTC proffer agreement, as long as you abide by the proffer agreement, your words won’t be used against you.

Are There Any Risks Involved in a CFTC Attorney Proffer?

The only real risk that may be involved in a CFTC attorney proffer is that you may end up accidentally making your case a bit too interesting. There is a thin line between telling all that you know and all that you need to tell the government.
