Why You Need a Certified Wage Attorney

Wage and hour laws in California are complex, with multiple overlapping statutes and regulations at the state and federal levels. Navigating this legal maze on your own is challenging, especially when you’re up against an employer with far more resources and legal firepower. That’s where a certified wage attorney comes in. These specialized lawyers have demonstrated their expertise in handling wage and hour claims by passing a rigorous certification process administered by the California State Bar. When you hire a certified wage attorney, you can trust that they have the knowledge, skills and experience to effectively advocate for your rights. Some of the key benefits of working with a certified wage attorney include:

  • Expertise in Wage and Hour Laws: Certified wage attorneys have an in-depth understanding of the various laws that protect employees’ rights to fair pay, including the California Labor Code, the federal Fair Labor Standards Act (FLSA), and local ordinances. They can quickly assess your situation and determine the best legal strategy for your case.
  • Experience with Similar Cases: Certified wage attorneys have handled numerous wage and hour claims for clients in a wide range of industries. This practical experience allows them to anticipate challenges, gather the right evidence, and craft compelling arguments to support your case. They know what it takes to win against even the most stubborn employers.
  • Reputation and Credibility: Earning a certified wage attorney designation is no easy feat. Lawyers must demonstrate a high level of competence and ethics to qualify for this prestigious title. When you work with a certified wage attorney, you send a strong message to your employer that you mean business and won’t back down until justice is served.
  • Access to Resources: Certified wage attorneys often work at well-established law firms with significant resources to support your case. This may include access to expert witnesses, private investigators, and other professionals who can help strengthen your claim. You’ll have a whole team in your corner, leveling the playing field against your employer.
  • Maximum Compensation: Certified wage attorneys are skilled negotiators and litigators who know how to get results. They’ll fight tirelessly to recover every penny you’re owed, including unpaid wages, overtime, meal and rest break premiums, and other penalties and damages available under the law. In many cases, they can also recover attorneys’ fees, so you pay nothing out of pocket.

How to Find a Certified Wage Attorney in Los Angeles

Now that you know the importance of hiring a certified wage attorney, how do you go about finding the right one for your case? Here are some tips to guide your search:

  1. Check the State Bar Website: The California State Bar maintains a directory of certified legal specialists, including wage attorneys. Visit their website at www.calbar.ca.gov and click on the “Attorney Search” tab. From there, you can search for certified wage attorneys in Los Angeles County.
  2. Ask for Referrals: If you know other employees who have successfully resolved wage claims, ask if they would recommend their attorney. Referrals from trusted sources can be a great way to find a reputable certified wage attorney in your area.
  3. Read Online Reviews: Many certified wage attorneys have online profiles on legal directories like Avvo, Martindale-Hubbell, and Super Lawyers. These sites often include client reviews and peer ratings that can give you a sense of the attorney’s reputation and track record.
  4. Schedule Consultations: Most certified wage attorneys offer free initial consultations to discuss your case and answer your questions. Take advantage of these opportunities to get to know the attorney and determine if they’re a good fit for your needs. Come prepared with a list of questions and any relevant documents.
  5. Trust Your Gut: Ultimately, you want to work with a certified wage attorney who makes you feel heard, respected, and confident in their abilities. If something doesn’t feel right during your consultation, trust your instincts and keep looking until you find the right match.

At Spodek Law Group, we’re proud to have some of the top certified wage attorneys in Los Angeles on our team. Led by Attorney Todd Spodek, our firm has a proven track record of success in handling complex wage and hour claims for employees across industries.

I don’t know where to start, I can write a novel about this firm, but one thing I will say is that having my best interest was their main priority since the beginning of my case which was back in Winter 2019. Miss Claire Banks, one of the best Attorneys in the firm represented me very well and was very professional, respectful, and truthful. Not once did she leave me in the dark, in fact she presented all options and routes that could possibly be considered for my case and she reinsured me that no matter what I decided to do, her and the team will have my back and that’s exactly what happened. Not only will I be liberated from this case, also, I will enjoy my freedom and continue to be a mother to my first born son and will have no restrictions with accomplishing my goals in life. Now that’s what I call victory!! I thank the Lord, My mother, Claire, and the Spodek team for standing by me and fighting with me. Words can’t describe how grateful I am to have the opportunity to work with this team. I’m very satisfied, very pleased with their performance, their hard work, and their diligence. Thank you team!

  • Unpaid Overtime: If you’re a non-exempt employee who works more than 8 hours in a day or 40 hours in a week, you’re entitled to overtime pay at a rate of 1.5 times your regular hourly wage. If your employer fails to pay overtime or calculates it incorrectly, we can help you recover the compensation you’re owed.
  • Misclassification: Some employers intentionally misclassify workers as independent contractors or exempt employees to avoid paying overtime and other benefits. If you believe you’ve been misclassified, we can help you assert your rights and recover any unpaid wages.
  • Meal and Rest Break Violations: California law requires employers to provide non-exempt employees with a 30-minute unpaid meal break for every 5 hours worked, as well as a 10-minute paid rest break for every 4 hours worked. If your employer denies you these breaks or requires you to work through them, you may be entitled to premium pay.
  • Off-the-Clock Work: If your employer requires you to perform work tasks before clocking in or after clocking out, such as setting up equipment or attending mandatory meetings, you may be entitled to compensation for this off-the-clock work.
  • Unpaid Business Expenses: If your employer requires you to use your own vehicle, cell phone, or other equipment for work purposes, they may be required to reimburse you for these business expenses. If they fail to do so, we can help you recover the money you’re owed.
  • Minimum Wage Violations: The minimum wage in Los Angeles is currently $15.00 per hour for employers with 26 or more employees, and $14.25 per hour for employers with 25 or fewer employees. If your employer pays you less than the applicable minimum wage, we can help you recover the difference plus penalties.
  • Final Paycheck Violations: If you’re fired or quit your job, your employer must pay you all wages owed on your final day of work (if you’re fired) or within 72 hours (if you quit with notice). If your employer fails to provide your final paycheck on time or in full, you may be entitled to waiting time penalties of up to 30 days’ wages.

These are just some examples of the types of wage and hour claims we handle at Spodek Law Group. If you believe your employer has violated your rights under California wage and hour laws, don’t hesitate to contact us for a free consultation.

Statute of Limitations for Wage Claims in California

It’s important to note that there are strict deadlines for filing wage and hour claims in California. In general, the statute of limitations for most wage claims is three years from the date of the violation. However, there are some exceptions:
