Philadelphia Accumulation of Points Lawyers

If you drive in the state of Pennsylvania, you need to be aware of the point system for your driver’s license. You have zero points when you are issued your license, and that is where you want it to stay. Unfortunately, even the most careful of drivers often receive a traffic violation eventually. When you end up with points on your license, your insurance rates can go up and you can possibly lose your license. This is why you will want to be aware of the points system and hire an experienced lawyer when you receive a violation. This is important because you will want to fight to have the points reduced or removed altogether if possible. You can save a lot of money and headache in so doing.

Traffic Violations and Points Explained

Pennsylvania has set up quite an elaborate system for assigning points to various traffic violations. Here are some examples that you should be aware of:

  • Failing to stop at a red light – 3 points
  • Not paying attention to a flashing red light – 3 points
  • Failing to yield the road to oncoming traffic – 3 points
  • Passing improperly while going up a hill – 3 points
  • Driving in a careless manner – 3 points
  • Leaving an accident scene that has caused property damage – 4 points
  • Going over the speed limit by six to ten miles per hour – 2 points
  • Going over the posted speed limit by 11 to 15 miles per hours – 3 points and a possible license suspension
  • Going over the speed limit by 16 to 25 miles per hours – 4 points and a possible license suspension
  • Going over the speed limit by more than 25 miles per hours – 5 points
  • Failing to yield to a pedestrian in a crosswalk – 2 points

As you can tell by now, there are quite a few reasons why you can have points added to your driving record. Any of these violations can cause you problems and a lot of money down the road. This is why you will want to fight any moving violation that you have, and that is where our office can help you.

What Happens When You Accumulate Six or More Points?

Up until this point, we have talked about a possible increase in your insurance rates if you start to get points on your record. There are other possible penalties to be concerned with as well, particularly if you accumulate six or more points. Starting at six points, your insurance company will be automatically notified of your violations. This means that your rates will likely go up. That is just the beginning.

After six points, the State of Pennsylvania will require you to take and pass another written exam. You have thirty days to do this. If you do not pass, then your license will be suspended until you are able to. Once you successfully pass the test, then two points will automatically be taken off your record. The second time you accumulate six points, you will have to go to court and make an appearance. If you do not, then you will receive an automatic sixty-day suspension. That hearing will largely determine your punishment moving forward, which can range from no penalty to a hefty fine and driving suspension. This is why you need legal representation to be with you.
