NY Penal Law § 265.25: Certain wounds to be reported

It is a crime under New York Penal Code § 265.25 to fail to report certain types of injuries to the police. The injuries in this statute include:


  1. bullet wounds
  2. powder burns
  3. gunshot wounds
  4. any injury arising from or inflicted by the discharge of a gun or firearm
  5. a knife or sharp instrument wound that has the likelyhood to or may result in death


The physician treating such a wound or the manager of the medical facility has the obligation of reporting such injuries to the police.


An Example

A man stumbles into a hospital emergency room with his hands clutching his abdominal area. He collapses on the floor.  The hospital staff rushes to him and they notice that he is bleeding profusely. On examining the man more closely, the staff determines that the man was suffering from a stab wound. The man then begs the doctor to not report the injury, saying that it was an accident. If the doctor neglects to report the injury to the police, that doctor could face prosecution for failing to follow the requirements of the charge of certain wounds to be reported.

The Sentence

Due to the fact that the charge of certain wounds to be reported is categorized as a class A misdemeanor, if convicted, you could be sentenced to up to 1 year in jail. Another possibility is that the judge will choose to not send you to jail, or only send you to jail for a short term, and instead sentence you to a 3 year probation term. If you do get placed on probation, there will be numerous rules that you will be obligated to follow, including consistently reporting to your probation officer, refraining from being in possession of any firearms and staying away from people who are known criminals. If you neglect to adhere to the rules, your probation may be revoked and you could be sent to jail.
