Liquor licenses are some of the most sensitive business licenses offered by the government today. They are a special privilege. The actions taken by companies with liquor licenses could save lives on the road or in numerous hospitals. Therefore, liquor license violations that do occur are heavily regulated by state and local governments. Businesses wanting a liquor license have to go through an extensive period of public comment and review just to receive their licenses in the first place. One major area of violations is allowing minors to drink. This violation may be the most serious and the hardest to control. Minors are often sophisticated in their efforts to avoid alcohol control efforts by bars. On some occasions, minors will use fake identification cards which they buy from counterfeiters. These fake IDs are often allowed into bars due to bouncers and doormen who are overwhelmed by crowds or poorly trained. But the consumption of alcohol by minors is illegal. It is a status crime and a misdemeanor for the minor who is drinking. Minors are more seriously affected by alcohol than adults and their judgment is poorer. They are inherently worse drivers who get into more traffic accidents than other demographic groups. Their livers are much weaker than those of older people, which increases the risk of overdose. Therefore, allowing minors to drink will lead to license suspensions and revocations faster than any other violation. These violations may even lead to criminal charges based on the involvement of the business in facilitating alcohol consumption by minors. If the minor goes on to cause a serious car accident or become hospitalized due to alcohol poisoning, the charges could be much more severe.

Another major violation area is giving alcohol to an intoxicated person. Giving alcohol to an intoxicated person can cause numerous problems for the person, the establishment, and greater society. A severely intoxicated person can suffer numerous health problems. They can fall and hit their head or succumb to alcohol poisoning. Customers who are given alcohol past the point of intoxication are much more likely to drive a car impaired than those who are not. Bars and restaurants that serve alcohol need to be trained in order to realize when a person is too intoxicated. When they are, it is the obligation of the bar or restaurant employees to refuse to sell alcohol to that individual.


There are a group of more infrequent violations that can also lead to problems with the state board. Infrequent violations include a poorly maintained establishment and having minors serving alcohol. Poor maintenance can cause safety and health concerns which are less than the state wants a liquor-serving establishment to have. Hiring minors to serve alcohol violates laws against public containers and the possession of alcohol by minors. It is much too easy for minors who are serving alcohol at an establishment to illegally drink. Bars and other establishments that serve alcohol must be sure that they are maintaining their facilities and that they are vetting their employees.

All of these violations are serious and should be treated and defended carefully. The utmost care should be taken to crafting a case and preparing a plea. Mistakes after a violation has been announced could result in a serious suspension or even a revocation of your liquor license.
