Understanding Federal Computer Hacking Charges in New York City

Getting charged with a federal computer hacking crime can be really scary. You may be wondering, “What did I even do?” or “What’s going to happen to me?” This article will break it down in simple terms to help you understand the charges, laws, defenses, and what to expect. I get it — this is confusing legal mumbo jumbo. I’ll explain things in a friendly way, so take a deep breath. We’ll get through this together.

What is Computer Hacking?

First things first, federal law defines computer hacking pretty broadly. Basically it means intentionally accessing a computer without authorization to obtain information, modify data, or do other shady cyber stuff.
I know…that sounds like a lot. Let me break it down:

  • A “computer” includes phones, tablets, networks, servers – pretty much any electronic device.
  • “Accessing without authorization” means hacking into somewhere you don’t belong.
  • “Obtaining information” means stealing private data.
  • “Modifying data” means messing with files or systems.

So if you logged into your ex’s Facebook, that’s illegal access. If you peeked at company files, that’s theft. And if you deleted your friend’s Minecraft world…well, they might hate you forever, but it probably won’t lead to federal charges.

What Are the Penalties?

Okay, let’s talk consequences. Federal computer hacking charges can lead to fines and years behind bars. Penalties vary based on things like:

  • What kind of data you accessed
  • If you damaged systems
  • Your criminal history
  • How much the victims lost financially

Some examples:

  • Just basic unauthorized access can mean up to 1 year in prison
  • Hacking a government system bumps that up to 10 years
  • Causing over $5,000 in damage or loss? Now we’re talking 5+ years
  • Major cyberattacks against critical infrastructure…yeah, that’s 20 years
