NJ License Suspension for Failure to Comply with IDRC Countermeasures Lawyers

Getting your driver’s license suspended in New Jersey can be a frustrating and challenging experience. But when it happens due to failure to comply with the state’s IDRC (Intoxicated Driver Resource Center) countermeasures program, it can feel especially unfair and burdensome.

The IDRC program is required for those convicted of DWI (Driving While Intoxicated) or refusal to take a breathalyzer test. It involves attending counseling sessions, classes, and more – all aimed at educating drivers about the dangers of drinking and driving. Failure to complete the IDRC program results in license suspension until you comply.

If your license was suspended for IDRC non-compliance, don’t panic. You have options. But you’ll need the help of an experienced New Jersey traffic lawyer to get your license back legally and quickly. Here’s what you need to know:

The IDRC Program in New Jersey

The IDRC program was established in New Jersey to “provide services to drivers convicted of alcohol or drug-related traffic offenses.” [1] It has two main components:

  • A mandatory orientation session
  • Counseling and education sessions tailored to each driver’s situation

At orientation, you’ll learn about the overall program requirements. Then a counselor will evaluate your personal history and make recommendations for counseling, classes, community service, and more. A typical IDRC program takes 6 months or longer to complete.

The goal is to change driver attitudes and behaviors related to alcohol and drug use. But many find the requirements overly demanding, especially if they live far from an IDRC location or have inflexible work schedules.

License Suspension for IDRC Non-Compliance

If you don’t complete all required IDRC activities by the court-ordered deadline, your license will be suspended. The Motor Vehicle Commission (MVC) is notified automatically when someone fails to comply.

In most cases, your license is suspended for one year from the date of non-compliance. But multiple IDRC failures can result in an indefinite suspension until you fully comply. Either way, you won’t be able to legally drive again until you:

  • Complete the IDRC program
  • Pay a $100 MVC restoration fee
  • Pay any other fines related to your DWI conviction

Completing the IDRC program is the most important step, but also the most time consuming and difficult. Without a license, you may have trouble getting to and from required counseling sessions and classes.

The Role of an Attorney in IDRC Compliance Cases

In State v. Leary, for example, a driver’s jail sentence for IDRC non-compliance was thrown out on appeal. The court ruled that jail time was not an authorized penalty in his case. [3]
