NJ Eluding Case Law in New Jersey: State v. Mendez Lawyers

Understanding the Crime of “Eluding” in New Jersey

Under NJ statute 2C:29-2, you commit the crime of eluding if you:

  • Knowingly flee or attempt to elude a police officer after receiving a signal to stop, AND

The Mendez Case and What It Means for Eluding Charges

State v. Mendez involved a defendant appealing his conviction for eluding police and resisting arrest. The case challenged jury instructions regarding the “attempt to elude” part of the statute.

At trial, the judge instructed jurors that the “attempt to elude” element is satisfied if the defendant’s driving “manifests an intent to elude” police. Mendez argued this was incorrect – an attempt requires proof of a “substantial step” towards eluding under general attempt liability principles.

The appellate court agreed with Mendez. They ruled that just manifesting an intent to elude is insufficient – the jury instructions should have required evidence that Mendez took substantial steps in a course of conduct planned to culminate in eluding police.

What This Means for Fighting Eluding Charges

The Mendez ruling has two big implications for defendants fighting eluding charges:

  1. Challenging “attempt to elude” evidence – The prosecution must prove more than just your intent to elude police. There must be evidence of substantial steps towards completing an eluding offense.
  2. Requesting proper jury instructions – If your case goes to trial, the jury must be instructed that “attempt to elude” requires proof of substantial steps, not just intent. This raises the prosecution’s burden of proof.
