THE BEST LAWYER ANYONE COULD ASK FOR.

The BEST LAWYER ANYONE COULD ASK FOR!!! Todd changed our lives! He’s not JUST a lawyer representing us for a case. Todd and his office have become Family. When we entered his office in August of 2022, we entered with such anxiety, uncertainty, and so much stress. Honestly we were very lost. My husband and I felt alone. How could a lawyer who didn’t know us, know our family, know our background represents us, When this could change our lives for the next 5-7years that my husband was facing in Federal jail. By the time our free consultation was over with Todd, we left his office at ease. All our questions were answered and we had a sense of relief.

NJ Drug Crimes

NJ Drug Crimes

New Jersey has some of the nation’s toughest drug laws. Charges for possession, distribution, manufacturing, and other drug offenses can lead to severe criminal penalties. Understanding the relevant statutes and defenses is critical for anyone facing drug allegations in New Jersey.

This article provides an overview of key topics related to NJ drug crimes. We’ll cover the major statutes, penalties, legal defenses, recent reforms, and more. With drug convictions carrying potentially life-long consequences, knowing the law is essential.

Common Drug Charges in New Jersey

New Jersey’s Comprehensive Drug Reform Act (CDRA) contains dozens of statutes covering all types of drug activity1. Common criminal charges include:

  • Possession of a controlled dangerous substance (CDS)
  • Possession with intent to distribute
  • Distribution/delivery of CDS
  • Manufacturing/production of CDS
  • Maintaining a drug manufacturing facility
  • Drug possession near a school zone
  • Possession of drug paraphernalia

Penalties vary based on the type and amount of drug, prior record, and other factors. But virtually all drug convictions in New Jersey carry stiff sentences.

New Jersey CDS Possession Laws

Simple possession charges are governed by N.J.S.A. 2C:35-10. It prohibits possessing controlled substances without legal authorization. Penalties depend on the substance, quantity, and intent2:

  • Small amounts for personal use may lead to 4th degree charges
  • Larger quantities suggest intent to distribute, meaning harsher penalties
  • Possession of marijuana is penalized less severely than other drugs

Possession of even tiny amounts of hard drugs like heroin or cocaine could mean jail time. Any CDS possession charge should be taken very seriously.

Distribution and Manufacturing Charges

Selling, making, or transporting illegal drugs leads to far more serious charges in New Jersey. Common statutes include3:

  • N.J.S.A 2C:35-5 – Manufacturing, distributing, dispensing CDS
  • N.J.S.A. 2C:35-6 – Employing a juvenile in drug distribution
  • N.J.S.A. 2C:35-11 – Distribution on or near school property

First degree charges for trafficking, sales to minors, and production operations can mean 10-20 years in prison. Parole disqualifiers are common as well.

School Zone Drug Offenses

Any drug crime within 1,000 feet of school property faces dramatically enhanced penalties under N.J.S.A. 2C:35-7. Common school zone charges include4:

  • Distribution of CDS in a school zone
  • Possession with intent to distribute in a school zone
  • Possession of CDS in a school zone
  • Manufacturing CDS in a school zone

School zone charges can turn a minor possession offense into a far more serious indictable crime. Mandatory prison time is common.

Penalties for NJ Drug Crimes

Sentences for drug convictions in New Jersey include5:

  • Fines up to $300,000
  • Probation or parole
  • Driver’s license suspension
  • Mandatory drug counseling or rehab
  • State prison time ranging from a few years up to life imprisonment

Penalties escalate sharply for repeat offenders. Those with an extensive drug history face potential life sentences even for minor new charges.

Defenses to Drug Charges in NJ

Conviction is never automatic – various legal defenses may apply to drug cases. Possible defense strategies include6:

  • Illegal search and seizure – Seek to exclude improperly obtained evidence
  • Entrapment – Argue police improperly induced you to commit the crime
  • Misidentification – The seized substance was not actually an illegal drug
  • Lack of possession – The drugs did not actually belong to you
  • Duress – You were forced to commit the crime under threat

An experienced criminal defense lawyer can assess the facts and help develop the strongest defense approach.

Recent Reforms to New Jersey Drug Laws

While still strict, New Jersey has implemented some reforms to its drug statutes in recent years. Changes include7:

  • Reduced penalties for marijuana possession
  • Mandatory drug treatment instead of jail for some first offenders
  • Easier expungement for past minor marijuana convictions
  • Expanded eligibility for diversionary programs like drug court

However, those hoping for broad decriminalization or legalization have been disappointed. Penalties for drugs beyond cannabis remain harsh.

Federal Drug Charges in New Jersey

The federal Controlled Substances Act also prohibits drug possession, sales, trafficking, and manufacturing. Federal charges often mean even steeper penalties, such as8:

  • 5-40 years for drug trafficking
  • 10 years to life for large operations
  • Up to 20 years for distribution
  • Up to 1 year for possession

Cooperation through a plea deal may be the only way to avoid decades in federal prison. Any federal drug investigation requires experienced legal counsel.

Finding an Attorney for Drug Charges

Drug crimes lawyers are critical for mounting a strong defense and mitigating penalties. An attorney can protect your rights at every stage, negotiate reduced charges when possible, and advise on strategic legal options.

Never go through drug charges alone. The costs of conviction follow you for life. The right lawyer provides experienced guidance and advocacy from the moment of arrest through sentencing and appeal.

Don’t leave your fate to chance. Contact an accomplished NJ drug crimes attorney as early as possible after an arrest.
