The Penalties for Simple Assault in New Jersey

Simple assault charges in New Jersey can really do a number on your life, even though it’s considered a minor offense. I know, because I’ve been there before. Getting charged with simple assault felt like the whole world was crashing down on me. I was scared, overwhelmed, and had no idea what to do next.

What Exactly is Simple Assault in New Jersey?

Simple assault falls under the disorderly persons offense category in New Jersey. That means it’s a minor criminal offense, not as serious as felony charges. But don’t let the “simple” name fool you – assault charges can still really complicate your life.

Under New Jersey law (N.J.S.A. 2C:12-1), you can face simple assault charges if:

  • You try to cause bodily injury to someone else, even if you don’t actually hurt them. Just attempting assault is enough.
  • You recklessly, knowingly, or purposely cause minor bodily injury to someone else. Even a small injury counts.
  • You cause bodily injury to someone else through negligence with a deadly weapon. For example, carelessly swinging around a baseball bat and hitting someone.
  • You threaten someone or put them in fear of bodily injury through physical menace – like waving a knife at them.

So simple assault covers everything from attempted assault, to threats, to minor injuries caused through recklessness or negligence. It’s a broad charge.

What Are the Penalties for Simple Assault in New Jersey?

The penalties you face for a simple assault conviction depend on the details of your case. But in general, potential penalties include:

  • Up to 6 months in county jail
  • Fines up to $1,000
  • Restitution to the victim to cover medical bills, lost wages, etc.
  • Mandatory anger management classes
  • Probation (potentially with electronic monitoring)
  • Community service
  • Permanent criminal record

And if the assault occurred in certain situations, the penalties can be even more severe:

  • If committed against an elderly person in a care facility, simple assault is a 4th degree crime. This ups the potential jail time to 18 months and the max fine to $10,000.
  • If committed in front of a child under 16 at a school or youth sporting event, it’s also a 4th degree crime with the higher penalties.

As you can see, even a minor simple assault conviction can really disrupt your life. You want to avoid jail time, fines, probation limitations, and a permanent criminal record if at all possible.

How Can I Fight Simple Assault Charges in New Jersey?
