The Penalties for Possessing Heroin in New Jersey

So you or someone you care about got busted with heroin in New Jersey. That sucks. As you probably know, heroin possession charges in the Garden State can lead to some pretty harsh punishments if convicted. Let’s break it down so you understand exactly what you’re looking at.

In New Jersey, heroin possession penalties mostly depend on the amount you’re caught with. The more you have, the more trouble you’re in. Makes sense, right? Here’s a quick rundown of the different amounts and potential penalties:

  • Less than 1/2 ounce – This is considered a third-degree crime. You could get 3-5 years in prison and up to a $35,000 fine. Not fun but better than…

  • 5 ounces or more – Welcome to first-degree territory. This kind of weight means 10-20 years in the slammer and fines up to $300,000. I’d say your goose is cooked.

But wait, there’s more! If you’re caught with any amount of heroin within 1,000 feet of a school or 500 feet of certain other public places, the charges automatically get bumped up one degree. So that less than 1/2 ounce suddenly becomes a second-degree crime if you’re too close to a school. Harsh but true.
