Is Sports Betting Legal in California?

The short answer is no, sports betting is not currently legal in the state of California. However, there have been recent efforts and proposals to legalize it. Let’s take a closer look at the current status of sports betting laws in California and what the future may hold.

Current State of Sports Betting Laws

As of now, sports betting is considered illegal across the board in California. The state constitution prohibits gambling unless regulations are specifically carved out for certain forms like horse racing or lottery. Sports wagering doesn’t have those exceptions – yet.
There was a 2018 ballot initiative to allow sports gambling at tribal casinos and racetracks, but it was removed by the California Supreme Court. So yeah, for the time being, you can’t legally place bets on sports in California. I know, it sucks.
The only legal option is to visit Las Vegas or bet with offshore sites, but even that comes with risks. I wouldn’t mess around with sketchy offshore books if I were you.

Ongoing Efforts to Legalize Sports Betting

While sports betting is banned under current state law, there have been a number of recent efforts and proposals to legalize it:

2022 Ballot Initiatives

There were a couple 2022 ballot initiatives that aimed to legalize sports betting, but neither gained enough signatures to qualify. Bummer.
One was backed by numerous Native American tribes, the other supported by large gaming companies like FanDuel and DraftKings. It seems there’s definitely interest on both sides to legalize sports wagering, but tribal disagreements blocked them from the 2022 ballot.

Proposed Constitutional Amendment

In late 2021, a proposed constitutional amendment was introduced in the state legislature to legalize sports betting.
If passed, the amendment would lift the ban, allow both online and in-person betting, and give regulation authority to the California Gambling Control Commission. This proposed legislation is still pending, but could potentially go on the 2024 ballot.

Tribal Compacts

Governor Newsom has also negotiated updated tribal gaming compacts with various Native tribes in the state. Some of them include provisions to allow sportsbooks on tribal lands once sports wagering is legalized.
So while these new compacts don’t change the legal status quo, they do lay the foundation for tribes to offer sports betting if it gets the green light in the future.

What Would Legal California Sports Betting Look Like?

If sports betting gets legalized (fingers crossed), what could we expect to see in California? Based on proposed legislation and comparisons to other states, it would likely include:

  • Both online and in-person betting options
  • Mobile sportsbook apps from top operators like FanDuel and DraftKings
  • Retail sportsbooks at tribal casinos and racetracks
  • Wagering on professional sports including NFL, NBA, MLB, NHL
  • Betting on college sports could be included or prohibited
  • Strict regulatory system overseen by state gambling commission
  • Tax revenue that supports public services and gambling addiction programs

California has nearly 40 million residents, so the sports betting market here could quickly rival Nevada. That means lots of great promotions, odds boosts, risk-free bets for new players, and awesome VIP rewards programs.
And with mobile and online betting, you’ll be able to place wagers safely from your phone – no need to deal with shady offshore sites or drive out to Vegas.

When Could Sports Betting Be Legal in California?

It’s tough to say for sure, but there seems to be gathering momentum to get sports betting in front of voters:

  • Mid 2023: Earliest possible ballot initiative if signatures are gathered in time
  • November 2024: Another chance if current proposals stall
  • 2025 and beyond: Bills introduced in the state legislature may take longer to pass

Legal wagering could arrive as early as 2023, but 2024 or 2025 may be more realistic timeframes.
And even if there are setbacks, the economic incentives make it seem inevitable that California will join the list of states with legal sportsbooks sooner rather than later. It’s only a matter of time.

What Can I Do to Support California Sports Betting?

If you want to see legal sports betting become a reality in California, here are some things you can do to help:

  • Contact local lawmakers and urge them to back sports wagering legislation
  • Voice support for ballot initiatives (when they happen) on social media
  • Sign petitions that aim to put legalization measures up for vote
  • Patronize tribal casinos that could offer sportsbooks in the future
  • Wait patiently as possible ballot measures and bills work their way through the legal process

As a sports fan in California, getting involved to accelerate legalization efforts can help. But ultimately, it comes down to responsible voters deciding sports betting should be allowed. Until then, no wagering for us!

The Future of Sports Betting in California

California was late to legalize other forms of gambling, so maybe it’s no surprise we’re behind the curve on sports betting too. But it sure looks like there’s momentum building to allow regulated wagering here in the coming years.
