THE BEST LAWYER ANYONE COULD ASK FOR.

The BEST LAWYER ANYONE COULD ASK FOR!!! Todd changed our lives! He’s not JUST a lawyer representing us for a case. Todd and his office have become Family. When we entered his office in August of 2022, we entered with such anxiety, uncertainty, and so much stress. Honestly we were very lost. My husband and I felt alone. How could a lawyer who didn’t know us, know our family, know our background represents us, When this could change our lives for the next 5-7years that my husband was facing in Federal jail. By the time our free consultation was over with Todd, we left his office at ease. All our questions were answered and we had a sense of relief.

Navigating Federal Child Pornography Charges: What You Need to Know

Facing federal child pornography charges can be an incredibly scary and overwhelming experience. As you try to understand the complex laws and sentencing guidelines, you likely have a million questions racing through your mind.I know this is an incredibly difficult time, but please know that you have options and there are skilled defense attorneys who can help. In this guide, I want to walk through some of the key things you should understand about these charges, your rights, and steps you can take.

An Overview of Federal Child Pornography Laws

There are a few main federal statutes that prosecutors use to charge crimes related to child pornography and exploitation:

  • 18 U.S.C. § 2251 – This law makes it illegal to produce or manufacture child pornography. Charges can include things like filming, photographing, creating digital images/videos, etc. More details on production charges
  • 18 U.S.C. § 2252 – This law covers the distribution, receipt, and possession of child pornography. So if you’ve downloaded images/videos, sent them to others, or even just had them saved on your computer, you could face charges.
  • 18 U.S.C. § 2252A – Very similar to 2252, but covers child porn related to digital images and the internet. So things like accessing illegal images online or sharing through email.

The penalties for simply possessing child porn are already severe, with 5-20 years in prison for a first offense. But it gets much worse if you’re charged with receipt or distribution under 2252/2252A, which carry mandatory minimums of 5-15 years.

Definitions – What is “Child Pornography” Under the Law?

An important thing to understand is that the legal definition of child pornography is very broad. It includes any visual depiction of sexually explicit conduct involving someone under 18 years old. It’s not just photos and videos depicting abuse or assault. Even computer-generated images can count. Cartoons, drawings, images that have been manipulated with editing software, etc. Basically if it visually depicts a minor engaged in sexual acts, it likely falls under the law.

Understanding Your Rights After an Arrest

If federal agents show up at your door or arrest you, it’s absolutely vital that you exercise your right to remain silent. Anything you say can and will be used against you, so do not answer any questions without your lawyer. You also have a right to speak with an attorney before deciding whether to answer questions or make any statements. Take advantage of that immediately. A defense lawyer can advise you on the best legal strategy.Police may pressure you to “cooperate” or talk by saying it’ll be better for you in the end. But in reality, talking without an attorney often backfires. It‘s best to politely decline to answer questions until you have legal counsel.

Building an Effective Legal Defense Strategy

Due to the strict sentencing rules around child pornography, building an effective defense is critical yet challenging. There are a few avenues skilled lawyers may pursue:

  • Fight the charges outright – In some cases, it may be possible to get charges dismissed or beat them at trial. For example, if you can show you never actually possessed illegal images. Or demonstrate authorized use/access due to work reasons. Beating charges is tough, but possible in the right circumstances.
  • Suppress evidence due to violations of your rights – If police violated your rights in their investigation, any evidence found may be suppressed. For example, if they searched your home without a warrant. This can weaken the prosecution’s case.
  • Mitigate and reduce sentencing exposure – One of the most important jobs of a defense lawyer is developing evidence and arguments that can lower sentencing guidelines and convince the judge to go below the minimums. This takes deep expertise and meticulous work assembling mitigating materials.

How Federal Sentencing Guidelines Work

While judges have some discretion, there are strict federal sentencing guidelines that determine penalty ranges for child porn offenses. It’s a complex formula based on things like:

  • The number and type of images (more = worse)
  • Characteristics of minors depicted
  • Your criminal history
  • Whether a computer was used
  • Evidence of distributing/sharing with others

Work closely with your defense counsel to understand where you may fall on the guidelines. This will give you an idea of the likely penalty if convicted. There are also mandatory minimums that kick in depending on the charges. For example, receipt or distribution carries 5-15 years mandatory prison time. Just possessing can be probation up to 10 years.

Steps You Should Take After an Arrest

Being charged with a child pornography crime can make you feel helpless and overwhelmed. But focusing on the steps below will help you navigate the process:

1. Remain Silent and Call a Defense Lawyer

Do NOT answer questions from police without an attorney present. Invoke your right to have counsel, and call a lawyer immediately. An experienced federal defense attorney can advise you on building the strongest case.

2. Avoid Discussing the Case With Anyone

Anything you say about your case, even in private to family/friends, could come back to haunt you. Keep quiet about details and focus on your legal defense.

3. Seek Out Support Services

While this is an incredibly difficult time, please seek help from counselors, therapists, support groups, close friends/family, or your religious community. You need support getting through this.

4. Educate Yourself on the Legal Process

Work closely with your lawyer to understand the charges, sentencing guidelines, mandatory minimums, and potential defenses. Knowledge is power, so learn all you can about the federal child porn laws. The most critical thing is contacting an experienced defense attorney immediately. They can guide you on next steps, build your case, and identify any options that may help reduce the penalties you are facing.

Finding the Right Federal Child Pornography Lawyer

Assembling the strongest possible legal defense team is crucial when facing federal child pornography charges. These are complex cases that require highly skilled lawyers with specialized expertise. Here are some tips on finding the right defense attorney:

  • Look for someone with extensive federal criminal defense experience. State courts are very different.
  • Find lawyers who regularly handle federal child pornography and internet crime cases. This area of law is extremely specialized.
  • Select a legal team with resources to assemble technical experts, mitigation specialists, forensic analysts and more. These cases require significant investigation.
  • Make sure they understand complex sentencing rules and mandatory minimums. Their job is crafting arguments to reduce your prison time.
  • Consider a public defender if you cannot afford private counsel. They handle these cases regularly.
  • Search lawyer directories like Avvo or NACDL to read reviews and credentials.

If you or a loved one are facing child pornography charges, you want the absolute best legal representation to protect your rights, build a strong defense, and reduce sentencing exposure as much as possible. Don‘t leave your future to chance – fight back.

What Happens at a Federal Sentencing Hearing?

If convicted of a child pornography charge, the final step is a formal sentencing hearing before a federal judge. This hearing has huge implications for the penalty and prison term you may face. The sentencing process works like this:

  1. The probation department will conduct its own investigation and compile background materials on you. They will issue a PSR (Presentence Investigation Report) with their recommended sentencing calculations.
  2. Your defense team will conduct its own in-depth investigation and assemble evidence/materials arguing for mitigation and a reduced sentence.
  3. In court, lawyers present arguments and evidence seeking the most lenient sentence. The judge also considers victim impact statements and other materials.
  4. After weighing all evidence, the judge announces their final sentenced per federal guideline rules and mandatory minimums.

This is your defense team’s opportunity to passionately argue why you deserve less prison time or alternative sentences. Skilled federal sentencing lawyers can navigate these complex hearings and achieve better outcomes.

What is Life Like in Federal Prison?

If you do receive a multi-year federal child pornography sentence, it’s understandable to feel terrified of prison life. While serving time is extremely difficult, focusing on a few things can help you get through it:

  • Keep your head down – Don’t get involved with gangs, drugs, or prison politics. Avoid trouble and conflicts.
  • Carefully choose associations – Be cautious in trusting others. But having a few positive people to talk to can make a difference.
  • Stay busy – Whether it’s work, education, hobbies, exercise, faith activities…find purpose in each day.
  • Focus on your release – Set goals to better your life for when you get out like education, counseling, rebuilding family ties.

Prison can be isolating and depressing. But try to remain positive, avoid conflicts, serve your time and focus on having a life after release. Take advantage of counseling and self-improvement programs.
