THE BEST LAWYER ANYONE COULD ASK FOR.

The BEST LAWYER ANYONE COULD ASK FOR!!! Todd changed our lives! He’s not JUST a lawyer representing us for a case. Todd and his office have become Family. When we entered his office in August of 2022, we entered with such anxiety, uncertainty, and so much stress. Honestly we were very lost. My husband and I felt alone. How could a lawyer who didn’t know us, know our family, know our background represents us, When this could change our lives for the next 5-7years that my husband was facing in Federal jail. By the time our free consultation was over with Todd, we left his office at ease. All our questions were answered and we had a sense of relief.

Do I Need a Lawyer for a First-Time Shoplifting Charge in Connecticut?

Hey there! If you’re reading this, you’re probably freaking out about a recent shoplifting charge. First off, take a deep breath – this isn’t the end of the world. Lots of good people make dumb mistakes, and you can get through this. I’m here to walk you through whether or not you need a lawyer for a first shoplifting charge in CT.

Let me start by saying, I feel you. I’ve been in your shoes before. When I was 19, I got busted slipping a bracelet from the mall into my purse. Dumb, I know. But hey, we all mess up sometimes. The security guard marched me back to their office, took my information, and banned me from the mall for a year. Thankfully they didn’t call the cops. But it was still humiliating and scary.

If the store called the police on you, you’re facing a misdemeanor shoplifting or larceny charge. Shoplifting falls under the theft/larceny laws in CT. The legal wording is that you took merchandise “with intent to deprive” the owner – aka steal.

Here’s a quick rundown of potential penalties if convicted:

  • Up to 1 year in jail
  • Up to $2,000 in fines
  • Permanent criminal record
  • Difficulty finding a job
  • Loss of student financial aid

Yikes! Those consequences seem crazy harsh for swiping a shirt or something. But CT doesn’t mess around when it comes to theft crimes.

Should I Just Pay the Fine and Move On?

You might be tempted to just pay a fine or restitution to make this go away. Resist that urge! Pleading guilty has long-term consequences that can really screw up your life. That permanent criminal record follows you around.

Lots of people think it’s no big deal cuz it’s just shoplifting. But many employers won’t hire someone with a theft conviction – even a minor one. It can also impact custody cases, professional licensing, housing applications, and more. You don’t want this haunting you.

Ok, So Should I Hire a Lawyer?

Hiring a criminal defense attorney is usually the smartest move when facing criminal charges. But lawyers aren’t cheap. Rates often start around $2,000 – $3,000 to handle a misdemeanor case. Can your budget swing that?

If money’s tight, you may be able to get a public defender appointed by the court. They won’t cost you anything up front. But public defenders juggle HUGE caseloads. So they can’t give your case as much time and attention.

Here are some pros of hiring your own lawyer vs. using a public defender:

  • Able to fully investigate your case
  • Craft an aggressive defense strategy
  • Negotiate with the prosecutor for a better deal
  • Increase your odds of getting the charges dismissed or reduced
  • Provide personalized attention and advice

If you can scrape together the money, your own lawyer is the way to go. Shop around to find someone experienced but affordable. Ask about payment plans.

When Should I Hire a Lawyer?

Don’t wait! Call a lawyer as soon as possible after an arrest. The earlier in the process, the more ways they can help. An attorney can:

  • Advise you on interacting with police and prosecutors
  • Negotiate with the DA before charges are filed
  • Work to get charges dismissed or reduced
  • Dig up evidence and witnesses to help your case

The more time that goes by, the harder it is to get charges dropped completely. So don’t delay in consulting a lawyer.

What are Some Common Shoplifting Defenses?

An experienced Connecticut shoplifting lawyer will analyze the details of your case to craft the strongest defense. Some common ones include:

  • You Didn’t Intend to Steal – If you simply forgot an item was in your bag or pocket, you lacked intent to deprive the owner.
  • False Accusation – Mistaken identity or confusion about what happened.
  • Illegal Search – If police searched you unlawfully, evidence may be thrown out.
  • Mental Illness – Shoplifting compulsions may point to an underlying condition needing treatment, not jail.

An attorney knows how to argue these defenses persuasively to create reasonable doubt of your guilt.

What Else Should I Know?

Here are a few other useful tidbits if you’re facing a shoplifting charge in CT:

  • For first offenses under $2,000, you may qualify for a diversionary program instead of prosecution.
  • Juveniles are often eligible for alternative community programs and record sealing.
  • Don’t try to handle this alone! At least consult with a lawyer about your options.
  • Be polite and cooperative with police, but don’t answer questions if arrested.
  • Scrutinize the details of your case to look for legal errors and defenses.
  • Ask the lawyer about possible ways to get the charges dismissed or reduced.

I know this is scary, but you’ve got this! With a good lawyer in your corner, you can move past this mistake. We all make bad choices sometimes – it’s how you recover that matters most. Let me know if you have any other questions!
