Do I Get My Bail Money Back if Found Not Guilty?

Getting arrested and charged with a crime is scary enough, but then you have to deal with posting bail while fighting the charges. Bail is money you pay to the court to be released from jail while your case is pending. It’s basically collateral to ensure you show up for court dates. But what happens if you’re found not guilty? Do you get that bail money back?

The short answer is yes, you do get your bail money back if you are acquitted or the charges are dropped. The bail money is meant to guarantee your appearance in court, not to punish you. So if you abided by the terms and showed up as required, the court has to return your bail payment when the case concludes in your favor.

How Bail and Bonds Work

There are a few ways bail can work:

  • You pay the full bail amount directly to the court. This money is returned when the case is over.
  • You pay a bail bondsman 10-15% of the full bail to post a bond for the remaining amount. You don’t get back the portion you paid the bondsman.
  • You pay nothing and a bail bondsman posts the full bond for a fee. Again, you don’t get back any money you paid the bondsman.

So in scenarios where you paid money directly to the court, you get that money back. But any fees paid to a bail bondsman are non-refundable. They take on the risk of ensuring you appear in court, and that service isn’t free.

What If I Violated Bail Terms?

If you get released on bail or bond but then violate the terms, like missing a court date or getting arrested again, the court will revoke your bail. Then you forfeit the money you paid and it won’t be returned if you are later acquitted or the charges dropped.

Bail is meant to incentivize compliance with court orders and ensure you show up for hearings. If you violate those terms, you lose the money regardless of the ultimate case outcome. The court views that as a separate issue from your guilt or innocence.

When Do I Get the Bail Money Back?

If you complied with all bail terms and are acquitted at trial or have the charges dismissed, you’ll get your bail money back. But when exactly? The timing varies by state and court procedures. Often the refund isn’t immediate upon a not guilty verdict.

You’ll likely need to file a motion with the court after the case concludes to retrieve the funds. This may take days or weeks to get approved and processed. The court will either send a check or require you pick up the cash in-person. Speak with your criminal defense lawyer about the process and timing in your jurisdiction.

What About Non-Monetary Bail Conditions?

Sometimes the court releases you without having to pay bail, but with other conditions like electronic monitoring, curfews, travel restrictions, etc. These are meant to ensure you return for court without paying money upfront.

If you comply with those non-monetary conditions and are found not guilty, you won’t get any bail money back – because you didn’t pay any. But your bail conditions will be lifted and you’ll regain your full freedom of movement and privileges.

Can I Sue for Wrongful Arrest?

Getting acquitted or having charges dismissed doesn’t automatically mean the arrest was improper or illegal. The standard for conviction is “beyond a reasonable doubt.” So you can be legally arrested based on probable cause but then found not guilty at trial.

However, if you feel the arrest was unjustified and without probable cause, you may be able to sue the police department for wrongful arrest. This is a civil lawsuit separate from the criminal case. You would need to prove the police acted improperly and without justification in arresting you.

These types of lawsuits are difficult to win though. Police are given broad discretion, and courts give weight to an officer’s judgment in the moment. But if you have evidence of malice, false statements, lack of probable cause, or other misconduct, you may have a case. Speak to a civil rights lawyer to explore your options.
