How Drug Addiction Can Impact Your Criminal Defense

The Link Between Addiction and Crime

There is an undeniable link between drug addiction and criminal behavior. In fact, abusing drugs or alcohol is a factor in 78% of violent crimes and 83% of property crimes, according to the National Council on Alcoholism and Drug Dependencies. The nature of addiction drives individuals to prioritize fulfilling their next fix over anything else. They may resort to illegal activities like theft or selling drugs to fund their habit.

Most states have laws in place to divert substance abusers into treatment programs rather than incarceration. But sometimes, the offenses are too severe or program criteria too strict. Other times, defendants miss opportunities for rehabilitation due to lack of information or resources.

How Addiction Impacts Criminal Cases

When representing clients with addiction issues, several key factors come into play:

  • Mental State – Intoxication or withdrawal symptoms can greatly impact a person’s mental state when a crime occurs. This may form the basis of defenses like temporary insanity, diminished capacity, or intoxication defenses.
  • Mitigating Factor – Addiction can be presented to judges and juries as a mitigating factor during sentencing. This gives insight into what drove criminal behavior with the aim of a more lenient punishment.
