Penal Code 237 PC – Punishment for False Imprisonment in California

Being falsely imprisoned can be a scary and traumatic experience. However, false imprisonment charges in California are complex and the laws surrounding them are nuanced. This article will provide an overview of California’s false imprisonment laws, penalties, and defenses.

What is False Imprisonment?

False imprisonment occurs when someone intentionally and unlawfully restrains, detains, or confines another person without their consent, making them stay or go somewhere against their will[1]. Violence or threats are not required elements of false imprisonment. Some examples of false imprisonment include:

  • Preventing someone from leaving by grabbing their arm
  • Locking someone in a room
  • Blocking someone’s car so they cannot drive away

However, if the “victim” consents to being confined or restrained, it is not considered false imprisonment. For example, escape rooms, haunted houses, and some BDSM practices may involve consensual restraint.

Misdemeanor vs. Felony False Imprisonment

False imprisonment can be charged as either a misdemeanor or felony offense in California. The main difference is whether violence or threats were used[2]:

  • Misdemeanor False Imprisonment – Restraining someone against their will through nonviolent means, such as blocking their exit. Punishable by up to 1 year in county jail.
  • Felony False Imprisonment – Restraining someone using violence, threats, menace, fraud or deceit. Punishable by up to 3 years in prison.

“Menace” refers to words or actions intended to threaten harm, while “fraud” and “deceit” refer to intentionally misleading the victim, such as by lying about a bomb threat.

Penalties for False Imprisonment

The penalties for false imprisonment depend on whether it is charged as a misdemeanor or felony, and whether the victim was an elder, dependent adult, or child[3]:

  • Misdemeanor – Up to 1 year in county jail and/or a fine up to $1,000.
  • Felony – 16 months, 2 years or 3 years in county jail.
  • Elder or Dependent Adult Victim – 2, 3, or 4 years in county jail.
  • Child Victim – 3, 6, or 8 years in prison.

If the false imprisonment was done for human trafficking purposes, it can be punished by up to 5-12 years in prison and a fine up to $500,000[4].

Legal Defenses
