Special Considerations in Same-Sex Queens Domestic Violence Cases

Special Considerations in Same-Sex Queens Domestic Violence Cases

Domestic violence occurs at similar rates in same-sex and heterosexual relationships. However, there are some unique aspects to same-sex domestic violence that present special considerations for victims, law enforcement, courts, and service providers.

Underreporting of Same-Sex Domestic Violence

Same-sex domestic violence is significantly underreported compared to heterosexual domestic violence. Reasons for this include:

  • Fear of revealing sexual orientation or gender identity
  • Lack of awareness of domestic violence services for LGBTQ victims
  • Concerns about discrimination from police, courts, shelters, etc.
  • Internalized homophobia and transphobia

This underreporting makes it more difficult to understand the scope of same-sex domestic violence and ensure that appropriate services are available.

Unique Tactics of Power and Control

While the overall dynamics of domestic violence are similar regardless of sexual orientation, abusers in same-sex relationships may employ additional tactics of power and control, such as:

  • Threatening to “out” the victim to family, friends, or employer
  • Telling the victim they will not be believed or will be discriminated against because of their sexual orientation or gender identity
  • Asserting the abuse is mutual or not serious since it occurs in a same-sex relationship
  • Restricting access to LGBTQ resources and community

These tactics exploit societal biases against LGBTQ people and prevent victims from seeking help. It is important for those supporting LGBTQ victims to recognize these unique tactics.

Bias and Discrimination

Unfortunately, LGBTQ victims often face bias and discrimination when seeking legal protection and social services. For example, police may decline to take a report, fail to gather key evidence, or even arrest the victim instead of the perpetrator. Shelters may refuse to house transgender women in women’s facilities. And courts may deny protection orders because the victim and abuser are of the same gender.

Training on LGBTQ cultural competence is essential at all levels of domestic violence response to counteract these issues. Additionally, partnerships between mainstream and LGBTQ-specific anti-violence programs can help bridge gaps.

Custody Concerns

Victims who have children with an abusive same-sex partner can face issues obtaining full custody. Courts may erroneously treat the case like a heterosexual divorce and award joint custody or visitation. Or they may deny parental rights to non-biological parents, forcing victims to share custody against their will. Updated policies and laws are needed to close these loopholes and protect victims and children.

Scarcity of Shelters and Services

Very few domestic violence shelters and services exist specifically for the LGBTQ community. Mainstream organizations are working to improve cultural competence, but capacity remains limited. Increased funding and support is critically needed to make lifesaving shelter and counseling available to more LGBTQ victims.

Help Is Available

If you or someone you know in the LGBTQ community is experiencing domestic violence, help is available. The National Domestic Violence Hotline provides confidential support and can connect you with resources in your area. Call 1-800-799-SAFE (7233) or visit www.thehotline.org to get started on a path to safety and healing.

What Friends and Family Can Do

Friends and family play a vital role in supporting LGBTQ victims of domestic violence. Here are some important ways to help:

  • Listen without judgment and offer unconditional support
  • Connect them with LGBTQ-friendly resources in your area
  • If they decide to leave, create a safety plan and help gather important documents, money, and necessities
  • Encourage them to press charges, seek protective orders, or pursue other legal options

With compassion and understanding, you have the power to make a difference in an LGBTQ loved one’s safety and future.

The Path Forward

While awareness of same-sex domestic violence has grown in recent years, there is still much work to be done. By supporting victims, improving policy and legal protections, expanding services, and countering anti-LGBTQ bias in all facets of society, we can build a future where no abuse victim feels unable to seek help because of their sexual orientation or gender identity.
