Options for Restoring Your Gun Rights in Queens After a Firearm Conviction

Having your gun rights restricted after a firearm conviction can be extremely limiting for Queens residents who wish to own guns for hunting, sport shooting, or self defense. However, there are legal options for restoring your Second Amendment rights in New York. The process is complex and success is not guaranteed, but with proper legal guidance, it is possible in some cases.

New York Firearm Restrictions

New York state has strict laws prohibiting firearm possession and use by people convicted of felonies and certain misdemeanors. This includes violent offenses, domestic violence charges, and some drug convictions.

In addition, the NY SAFE Act prevents people with certain mental health histories from purchasing or possessing guns. These bans are essentially lifelong with no expiration.

So if you have a prior conviction on your record in New York, you cannot legally buy, own, or even hold a gun without going through a restoration process.

Restoring State Gun Rights

There are two main options for restoring your state-level right to own firearms in New York after a conviction, both of which require court approval:

  • Certificate of Relief from Disabilities – Creates a presumption of rehabilitation for people with misdemeanors or one felony.
  • Certificate of Good Conduct – For people with more extensive criminal histories.

The requirements and process differs slightly depending on which option you pursue.


Eligibility often depends on the number and type of convictions, how long ago they occurred, and your record since then. Talk to a lawyer to understand your specific options.

In general, Certificates of Relief are for people with:

  • Any number of misdemeanor convictions
  • One felony conviction

Certificates of Good Conduct may help people with:

  • Two or more felony convictions
  • A history of multiple misdemeanor and felony convictions

Application Process

So while a Certificate can help regain your New York gun ownership privileges, interstate transport and purchases may still be prohibited without a pardon.

In addition to banning gun possession, a criminal conviction can prevent you from getting certain jobs, professional licenses, government benefits, housing assistance, voting rights, and other civil liberties.

Certificates of Relief and Good Conduct can lift some of these restrictions and create a “presumption of rehabilitation.” Consult with an attorney to understand how your specific conviction may limit other rights.
