In New York, simply possessing illegal drugs does not necessarily mean you will be charged with intent to sell. However, there are certain factors that prosecutors and police look for as evidence that someone intended to sell or distribute drugs. According to New York law, the following factors may be used as evidence that a person intended to sell or distribute illegal drugs:
