What Qualifies as a Criminal Street Gang in New York City?

New York has strict laws regarding criminal street gangs. A gang is defined as a group of three or more people that engages in criminal activity or plans to engage in criminal acts. To prosecute someone under New York’s anti-gang laws, prosecutors must prove the group meets certain criteria.

Defining a Criminal Street Gang

There are a few key elements that define a street gang under New York law:

  • The group must have three or more members. If there are only one or two people, it does not qualify as a gang.
  • Members of the group engage in a pattern of criminal gang activity. This means they repeatedly commit crimes like drug trafficking, assault, robbery, etc.
  • The group has some permanency and structure. There is some hierarchy and roles among members. The gang exists over time, not just to commit one crime.
  • The group has a common name, sign, symbol, or other means of identification. Members use colors, clothing, tattoos, graffiti, or hand signs to show their affiliation.

Types of Gangs in NYC

Some of the most well-known gangs in New York City include:

  • Bloods: Originated in Los Angeles but now have a strong presence in NYC and other East Coast cities. Known for wearing red and using graffiti containing the letters “CK” for “Crip Killer.”
  • Crips: Began in Los Angeles and also spread to various cities on the East Coast. Members wear blue and avoid using the letter “B.”
  • Latin Kings: One of the largest Latino street gangs in the U.S. Members often have tattoos containing a five-point crown or the letters “ALKN.”
  • MS-13: Originated in Los Angeles but has members across the U.S. and Central America. Members use the gang’s hand sign of interlocking MS fingers.
  • Aryan Brotherhood: White supremacist prison gang that operates both inside and outside jail/prison walls. Members have AB tattoos and Nazi symbolism.

Requirements for Gang Prosecution

To prosecute an individual for gang-related crimes in New York, the prosecution must prove:

  • The defendant committed the underlying offense (e.g. assault, drug sale).
  • The defendant committed this crime as part of an identified criminal street gang.
  • The defendant intended to commit the crime to further or assist the gang.

Merely being a member of or associating with a gang is not enough. The prosecution must tie the specific criminal act to furthering the interests and activities of a street gang.

Penalties for Gang Membership

Under New York law, participating in a criminal street gang is a class E felony punishable by:

  • Up to 4 years in prison
  • Fines up to $5,000
  • 5 years probation

If convicted of other felonies “in concert” with a gang, the defendant will face even stiffer penalties. They can receive an additional 5-15 years in prison if convicted of a violent felony as part of a pattern of gang activity.
