New York has strict laws regarding criminal street gangs. A gang is defined as a group of three or more people that engages in criminal activity or plans to engage in criminal acts. To prosecute someone under New York’s anti-gang laws, prosecutors must prove the group meets certain criteria.

Defining a Criminal Street Gang

There are a few key elements that define a street gang under New York law:

  • The group must have three or more members. If there are only one or two people, it does not qualify as a gang.
  • Members of the group engage in criminal acts like drug dealing, extortion, intimidation, violence, or weapons trafficking. Their crimes are usually done to benefit the gang in some way.
  • The group has some identifying sign, symbol, style of dress, or handshake that shows gang membership or affiliation. Common identifiers are certain colors, clothing styles, tattoos, graffiti art, or gestures.

Prosecutors look at the full pattern of activity to determine if a group qualifies as a criminal street gang. Isolated incidents of crime are not enough. There must be an ongoing pattern or conspiracy to commit crimes.

Gang Activity That Leads to Charges

There are several New York laws that target gang-related criminal activity:

  • Participating in a criminal street gang
  • Recruiting minors into a gang
