New York has strict laws defining criminal street gangs and imposing enhanced penalties for gang-related crimes.   • Have an organizational structure with defined leadership and roles for members
  • Regularly engage in criminal activity for financial gain
  • Use violence, threats, intimidation to further the gang’s criminal objectives

Types of Gangs in NYC

New York City has long grappled with gang violence from organized groups like (https://www.quora.com/What-are-the-most-dangerous-gangs-in-New-York-City):

  • Latin Kings: One of the largest Latino street gangs in NYC with over 300 members. Known for drug trafficking.
  • MS-13: Notorious international gang with a presence in Queens/Long Island. Linked to brutal violence and murders.

Requirements for Gang Designation

  • The group has an identifiable leadership and organizational structure
  • Three or more members of the group are involved in a “pattern of gang activity”
  • The group regularly engages in criminal activity for financial gain
  • The group uses violence or intimidation to further its criminal objectives

A “pattern of gang activity” means:

  • At least three gang-related crimes were committed
  • Two of those offenses occurred within three years of each other
  • The most recent offense occurred within three years of the prior offense

Gang Membership Charges

Under New York Penal Code §460.10, it is illegal to:

  • Be actively involved with a criminal street gang
  • Intentionally promote or further the criminal objectives of a gang

Penalties for gang membership depend on the underlying criminal activity but may include up to 1-1/3 to 4 years in prison. Simply belonging to a gang or wearing gang colors is not enough to prove gang membership charges. Prosecutors must show:

✔️ Active participation in gang-related crimes

✔️ Knowledge of and intent to further the gang’s criminal activity

Enhanced Penalties for Gang Crimes

  • Cutting off contact with former gang associates
