How Do I Remove My Mugshot from the Internet in New York City?

How to Remove Your Mugshot from the Internet in New York City

Having your mugshot posted online can be embarrassing and damaging to your reputation. Luckily, there are steps you can take to get your mugshot removed from websites in New York City.

Understanding Mugshots and Your Rights

A mugshot is a photograph taken after someone is arrested and booked into jail. The purpose is to identify the arrested person and document the booking process.

Mugshots are considered public records in New York. That means websites can legally obtain and post mugshots online, even charge a fee to remove them. However, you do have rights when it comes to using your name and image.

Getting Your Mugshot Removed

While websites have the right to post mugshots, here are some steps you can take to get your mugshot removed:

1. Contact the Website Directly

The easiest way to get your mugshot removed is to contact the website directly. Look for a “removal request” link or contact info on the website. Explain that you believe the continued publication of your mugshot is unlawful. Be polite and reasonable in your request.

Many sites will remove mugshots upon request, especially for first-time and lower-level offenses. However, some websites will try to charge an outrageous “admin fee” to take down the photo. You can choose to pay the fee, but you may want to try other removal options first.

2. File a Complaint with Google or Bing

If a website refuses to remove your mugshot, you can file a complaint with search engines like Google or Bing. Ask them to remove the webpage with your mugshot image from their search index. This helps de-index the page so it doesn’t show up in search results.

To do this, search for the offending page on Google or Bing. Click the downward arrow icon next to the result and choose “Remove result.” Explain why you believe the page violates the search engine’s policies.

3. Send a DMCA Takedown Notice

You can also send a formal DMCA (Digital Millennium Copyright Act) takedown notice. Explain that the website does not have the rights or permission to use your name and image. Request they immediately remove the mugshot according to DMCA law.

There are DMCA takedown notice templates online you can reference. Make sure to include your contact info and specific webpage URLs you want removed.

4. Contact a Lawyer

If you’ve tried the steps above with no success, consider contacting a lawyer. A defamation attorney can send a formal notice demanding websites remove your mugshot. They can also file a lawsuit if websites refuse to comply.

Other Ways to Lessen the Impact

As you work to get your mugshot removed, here are some other things you can do:

  • Opt-out of mugshot sites: Opting out of sites like Mugshots.com prevents them from posting your mugshot in the future. This doesn’t remove your photo if it’s already posted.
  • Bury negative search results: Creating positive online content about yourself can help bury mugshot search results. This makes the mugshot less visible in search engines over time.
  • Dispute background check info: If your mugshot appears on a background check report, you can dispute it with the screening company. Explain it’s defamatory, inaccurate, or unlawfully obtained information.

Removing a mugshot from the internet takes persistence and patience. But understanding your rights and using the various removal options can help you take back control of your online reputation.
