Arrested for DUI with a Child in the Car in Queens? Legal Help Can Lessen the Blow

Getting arrested for DUI is scary enough, but when there’s a child in the car, it’s a whole different ballgame. The stakes get raised real quick in New York with Leandra’s Law, which makes it a felony to drive drunk with a kid under 16 in the vehicle. We’re talking up to 4 years in prison if convicted. Yikes!

But don’t panic. Getting busted is bad, but it ain’t over yet. Having a good lawyer on your side can make a huge difference. Let’s break this down so you know what you’re facing and how to handle it.

The Charges

Under Leandra’s Law, it’s a class E felony just to drive buzzed with a child passenger. That means up to 4 years in the slammer even if it’s your first offense. And if the child gets seriously hurt, it becomes a class C felony with up to 15 years. Worst case, if a child dies, we’re talking a class B felony and up to 25 years, with a minimum of 5. Other penalties include:

  • Fines up to $5,000
  • 5 years probation
  • License suspension for at least a year
  • Ignition interlock device installation
  • $520 surcharge plus $750 assessment over 3 years

It’s no joke. The law comes down hard to protect kids from drunk drivers. Even if you made an honest mistake, the cops and courts don’t play around.

The Arrest Process

After getting pulled over, the cops will investigate for signs of intoxication – bloodshot eyes, slurred speech, trouble standing or walking, etc. You may have to take field sobriety tests like standing on one leg or walking a straight line. Just say no to any tests, as they’re designed for you to fail.

If the cops think you’re drunk, they’ll arrest you and take you to the station. That’s where they’ll ask you to take a breathalyzer test to measure your blood alcohol level. You have the right to refuse, but then they can suspend your license. Either way, don’t admit guilt or say anything without your lawyer present.

Getting a Lawyer Fast

After arrest, you’ll be booked and held until arraignment when you go before a judge. This is usually within 24 hours. The court will assign a lawyer if you can’t afford one, but it’s best to contact your own ASAP. An experienced DUI attorney will know how to navigate the system and fight for your rights.

A good lawyer can sometimes get charges reduced or even dismissed. They’ll look for holes in the prosecution’s case, like if the traffic stop or breath test was invalid.
