An Overview of Pennsylvania Drug Court Programs

Pennsylvania drug court programs provide a great opportunity for folks struggling with addiction to get the help they need instead of just being locked up. They combine counseling, treatment, testing, and judicial supervision to try to break the cycle of addiction and crime. This article will give an overview of how these programs work in Pennsylvania, who is eligible, and what the benefits are.

What are drug courts?

Drug courts are specialized court programs that focus on helping participants recover from drug and alcohol addiction. Instead of just throwing people in jail, drug courts give them a chance to get sober and turn their lives around. Participants have to follow strict rules, undergo frequent drug testing, appear in court often so the judge can monitor their progress, and complete a treatment program. It’s hard work but it gives people a chance to recover and avoid a criminal record. There are drug courts now in many Pennsylvania counties.

How did they start in PA?

Pennsylvania’s first drug court opened up in Philadelphia back in 1997. It was an adult drug court program. This led to the creation of the Pennsylvania Association of Drug Court Professionals (PADCP) to advocate for more drug courts in PA. Since then, the number of problem-solving courts like drug courts, DUI courts, mental health courts, and veterans courts has really expanded across the state. So today there are lots of options for people struggling with addiction to get help through these programs instead of just being incarcerated.

What are the benefits?

There are many benefits to completing a drug court program instead of just serving time in jail or prison. Here are some of the main benefits:

  • Avoid a criminal record – Charges can be dismissed upon completion
  • Lower chance of reoffending – Much lower recidivism rates for graduates
  • Get sober – Complete substance abuse treatment
  • Improve life skills – Counseling, education, job assistance
  • Family support – Chance to improve family relationships
  • Accountability – Strict monitoring by the court

Research shows that completing drug court has better outcomes for participants than just incarceration. Graduates have less future arrests and drug use. It gives people a chance to turn their life around with support.

What’s the process?

Each county in PA has its own eligibility rules and process for drug court admission. But generally it goes like this:

  1. Arrest for a nonviolent, drug-related offense
  2. Screening and clinical assessment for drug abuse
  3. Prosecutor determines legal eligibility
  4. Defendant chooses to apply and is accepted into the program
  5. Treatment and judicial monitoring for 12-24 months
  6. Graduation leads to charges being dismissed

So instead of prosecution, eligible defendants can choose drug court for a chance at recovery. There are four phases with treatment, counseling, community service, drug testing, and court appearances throughout the program. Weekly progress reviews help keep participants on track. Graduates can earn a clean slate.

What are the eligibility requirements?

Each county drug court may have different eligibility rules, but there are some common requirements:

  • Nonviolent, drug-related offense
  • Drug abuse assessment showing addiction
  • No disqualifying criminal history
  • Clinical and legal eligibility
  • Voluntarily choose drug court program

Applicants have to show they have a drug problem and need help with recovery. Typically only nonviolent offenders are eligible. And you have to voluntarily choose drug court, you can’t be forced into it.

What’s included in drug court programs?

If you enter a drug court program, here are some of the key things you’ll have to complete:

  • Treatment – Individual and group counseling, outpatient and/or inpatient rehab
  • Drug testing – Random tests at least twice per week
  • Court hearings – Weekly check-ins with the judge
  • Supervision – Probation officers monitor participation
  • Incentives & sanctions – Rewards and punishments for progress
  • Life skills classes – Budgeting, job preparation, education

It’s an intensive program focused on treatment and accountability. But it also offers a supportive environment for recovery. Participants have access to many services to help get their lives on track.

What happens if you don’t complete the program?

Not everyone who enters drug court ends up graduating. If you fail or give up, here’s what happens:

  • Return to regular criminal prosecution
  • Entry of guilty plea or trial for charges
  • Potential jail or prison sentence
  • No record expungement

So if you don’t cut it in drug court, you end up right back where you started in the criminal justice system. That’s why it’s so important to take the program seriously and work hard – it’s a second chance to avoid prosecution.
