What is the CFTC and What is it Designed to Do?

The United States Commodity Future Trading Commission(CFTC) is designed to investigate and then prosecute any violations of the Commodity Exchange Act and associated regulations that it comes across. Ever since the passage of the Dodd-Frank bill, the power of the CFTC has grown by leaps and bounds.

The CFTC is overseen by a board of five commissioners. One of these five commissioners will be designated as the Chairman. These five are appointed by the President, although these appointments will be subject to confirmation by the Senate. No more than three of these five are allowed to come from the same political party.

There are four main divisions of the CFTC. These include the following:

  • Swap Dealer and Intermediary Oversight
  • Clearing and Risk
  • Enforcement

The basic premise of the CFTC is that it is meant to protect commodity trades and traders from being defrauded. Futures trading is an activity that has certainly benefited from a higher level of transparency and basic fairness. The CFTC has gone a long way toward meeting its stated goals in this particular area.

What Happens When the CFTC Decides to Investigate?

If it has reason to suspect that fraud or other types of suspicious activities are taking place, it will intervene. The level of clampdown that may occur can range from a minor referee action to a series of major arrests.
