The credit worth chasing when you are carrying debt is the one that pays before profit does. The research credit can be elected against employer payroll taxes, up to $500,000 a year. WOTC, the small employer health care credit and the disabled access credit come next. None of them stop a daily ACH debit.
- A qualified small business can apply the research credit against up to $500,000 of employer payroll tax a year. It does not wait for taxable income.
- WOTC is worth $2,400 on a standard hire and up to $9,600 on some veterans, but Form 8850 has to reach the state agency within 28 days of the start date.
- The disabled access credit refunds 50% of eligible spending above $250, on up to $10,250 of spending. Maximum credit $5,000 a year.
- A settled advance can arrive as a 1099-C. Form 982 and the insolvency test are what stop it from becoming a tax bill.
Every accountant tells a struggling owner to look at credits. Almost nobody sorts them by the only thing that matters when a funder is debiting your account every business day: when the money actually arrives. A credit that carries forward against future income tax is a promise. A credit that comes off next quarter's payroll deposit is cash.
This page sorts them that way. Four credits that a small business carrying debt can realistically use, the deadline or election that decides each one, and the form that handles the tax bill after an advance gets settled. Figures are from the Internal Revenue Code and the IRS forms named in each section. Nothing here is a substitute for your accountant reading your return.
A credit cuts the tax bill. The debit does not care.
A tax credit is a dollar off what you owe the IRS. A merchant cash advance is a dollar pulled out of your operating account tomorrow morning. Those two events rarely meet. If a funder takes $840 every business day, a $12,000 credit claimed on a return filed in March does nothing for the Tuesday in September when payroll clears.
Sort credits by when the money lands. First, credits you can elect against payroll tax, because they pay a company with no profit. Second, credits that reduce a bill you are about to pay this year. Last, credits that carry forward through the general business credit, which are worth real money only in a year you have taxable income.
Most guides list them in the order the IRS publishes them. That order is useless to an owner who is 40 days from a levy. The three sections that follow are in cash order, and the last one is not a credit at all. It is the form that keeps a settlement from turning into a five-figure tax problem.
The research credit is the only one that pays a company with no profit
The section 41 credit is described as a reward for laboratories. The statutory test is wider: developing or improving a product, process, software, formula or technique through a process of experimentation. A machine shop proving out a new tooling sequence qualifies. So does a software company rebuilding its pricing engine and scrapping two versions on the way.
The part that matters here is the payroll election. A qualified small business, meaning gross receipts under $5 million for the year and no gross receipts more than five years back, can elect on Form 6765 to apply the credit against employer payroll taxes instead of income tax. The cap is $250,000 against the Social Security portion and another $250,000 against the Medicare portion. That is $500,000 a year.
You make the election on a timely filed return, then apply it starting the quarter after you file, on Form 8974 attached to the 941. The result is cash off a payroll deposit you were going to wire anyway. Keep the contemporaneous records: project, people, hours, what failed. The credit that survives an exam is the one documented while the work happened.
WOTC is decided in the first 28 days of a hire, not at filing
The Work Opportunity Tax Credit pays for hiring from targeted groups: certain veterans, SNAP recipients, people released from incarceration, the long-term unemployed, residents of designated communities. The standard credit is 40 percent of the first $6,000 of first-year wages, so $2,400 a head. Some veteran categories reach $9,600.
The deadline is what kills it. Form 8850 has to go to your state workforce agency within 28 days of the employee's start date. Not 28 days from when your accountant mentions the credit in February. Miss the window and a perfectly qualified hire is worth nothing.
So this is an onboarding problem, not a tax problem. Put the questionnaire in the new hire packet next to the W-4 and give one person responsibility for mailing it. For a business that replaces staff quickly, a restaurant, a staffing agency, a warehouse, the annual number gets large on volume alone. The credit is nonrefundable and runs through the general business credit, which means it reduces income tax and carries forward, so it is a strong credit in a recovery year and a weak one in a loss year.
The small employer health care credit is worth half the premium, twice
If you cover employee health insurance, the small employer credit is up to 50 percent of the premiums you paid, or 35 percent for a tax-exempt employer. The conditions are specific: fewer than 25 full-time equivalent employees, average annual wages below the indexed limit for the year, you pay at least half of the employee-only premium, and the coverage was bought through the SHOP marketplace. It is claimed on Form 8941.
The limit owners miss is the one that cannot be undone. The credit is available for two consecutive taxable years, total, and the clock starts the first year you claim it. Burn a year on a small payroll and a cheap plan and you have spent half of what this is worth for the life of the company.
So time it. If headcount is about to cross 25 full-time equivalents, or renewal is going to raise premiums sharply, the year you claim first changes the dollars materially. Ask the accountant to model both years before the election, not after the first return is filed.
The disabled access credit refunds half of a $10,250 job
Form 8826 covers 50 percent of eligible access expenditures above $250, on up to $10,250 of spending. The maximum credit is $5,000 in a year. You qualify as an eligible small business if gross receipts were $1 million or less in the prior year, or you had 30 or fewer full-time employees.
Eligible spending is concrete rather than theoretical: removing architectural barriers, a ramp, restroom modifications, interpreters, readers, materials in accessible formats, adaptive equipment. A restaurant that widens a doorway and rebuilds one restroom can reach the spending cap on a single contractor invoice.
Two cautions. The same dollars cannot be both credited and deducted, so the work has to be split correctly on the return. The separate barrier removal deduction under section 190 covers a different slice of the same project, and a return can use both on different dollars. Have your accountant tell the contractor how to break out the invoice before the work starts. Fixing the allocation afterwards from one lump sum invoice is where this credit usually gets lost.

The form that saves the most money is not a credit at all
When a settlement closes, the tax problem arrives by mail. A funder that writes off $60,000 may issue a 1099-C, and cancelled debt is income unless an exclusion applies. Owners who negotiated hard on the settlement number routinely hand that saving straight back in April.
The exclusion most owners qualify for is insolvency. If your liabilities exceeded the fair market value of your assets immediately before the discharge, you exclude cancelled debt up to the amount of that insolvency, on Form 982. A title 11 bankruptcy discharge is a separate and complete exclusion. Neither applies by itself. You file the form and you keep the balance sheet that proves the number, dated the day before the discharge.
The arithmetic is worth the trouble. A $60,000 write-off taxed at 24 percent is a $14,400 bill for nobody filing a one-page form. Ask the settlement firm for the discharge date in writing when the deal closes, and hand it to your accountant the same week, while you can still document what you owed and what you owned.
How we evaluated this
Twelve firms were scored on the weighted criteria at left. Attorney involvement carries the most weight on this page for a narrow reason: the tax items here are handled by a CPA, and the debt items are handled by counsel. A settlement company sits in neither chair and charges as though it sits in both.
Fee basis was scored second. A credit is a fixed number, and the fee that eats it should be measured the same way. A percentage of enrolled debt and a percentage of the settled amount produce very different bills on the same file.
Timeline was scored against the tax calendar rather than against comfort. A quarterly payroll offset, an April filing deadline and a 1099-C all land on dates. A 24 to 48 month program does not.
Questions owners ask
Can a tax credit pay off a merchant cash advance?
No. Credits reduce tax, and an advance is a private contract debt collected by ACH. The research credit payroll election is the closest thing to cash, because it comes off employer payroll taxes up to $500,000 a year rather than waiting for taxable income. It frees money you would have wired to the IRS. It does not reduce the balance the funder is owed.
Which credit helps a business that lost money this year?
The section 41 research credit, elected against payroll tax on Form 6765 by a qualified small business with gross receipts under $5 million. It is applied on Form 8974 with the 941 beginning the quarter after the return is filed. Most other business credits run through the general business credit, which needs income tax to offset, so a loss year defers them.
I hired someone who clearly qualified for WOTC. Can I still claim it?
Only if Form 8850 reached your state workforce agency within 28 days of the start date. That certification request is a condition of the credit, not paperwork you catch up on at filing. If the window closed, the credit is gone for that hire. Fix the process now: the form belongs in the onboarding packet with the W-4.
Is the Employee Retention Credit still available?
The filing windows have closed. Claims for 2020 quarters had to be filed by April 15, 2024, and claims for 2021 quarters by April 15, 2025. Anyone selling you an ERC claim in 2026 is selling something that cannot be filed. If you already claimed one through a promoter and the numbers were inflated, talk to a CPA about the IRS resolution options before an exam finds it.
Do I owe tax on the part of an advance the funder wrote off?
Possibly. Cancelled debt is income unless an exclusion applies, and a funder may issue a 1099-C. The common exclusion is insolvency: liabilities exceeding the fair market value of assets immediately before the discharge, claimed on Form 982. A bankruptcy discharge is separately excluded. Both require the form and documentation dated to the discharge.
How much is the small employer health care credit actually worth?
Up to 50 percent of the premiums you paid, or 35 percent for a tax-exempt employer, on Form 8941. You need fewer than 25 full-time equivalent employees, average wages under the indexed limit, at least half the employee-only premium paid by you, and SHOP coverage. It is available for two consecutive years total, so the year you start it matters.
Can I claim credits if I am behind on payroll taxes?
Credits and delinquent deposits are separate problems. The research credit offsets current employer payroll tax, not past-due amounts, and unpaid trust fund withholding carries personal exposure for responsible persons under section 6672. A credit does not shield anyone from that. Get the delinquency into a resolution channel before planning around the offset.
Should I wait for the refund before dealing with the advances?
No. Refunds and offsets run on quarterly and annual calendars. A funder debits daily and can file a UCC-1, notify your customers, or sue. If the debits are outrunning deposits now, get the contracts read this week. The tax work continues in parallel, and the discharge date from any settlement feeds straight into the Form 982 computation.
The bottom line
Work the credits that pay before profit does, starting with the research credit payroll election at $500,000 a year and the WOTC form that dies at day 28. Then deal with the advance separately, because no credit on the return moves the ACH debit that clears tomorrow. If a settlement is already done, file Form 982 with the insolvency computation before the write-off becomes a tax bill.
