What Qualifies as Intent to Sell Drugs in New York City?

In New York, simply possessing illegal drugs does not necessarily mean you will be charged with intent to sell. However, there are certain factors that prosecutors and police look for as evidence that someone intended to sell or distribute drugs. Understanding what qualifies as intent can help you better understand the potential charges and penalties you may face.

Factors Used to Establish Intent

According to New York law, the following factors may be used as evidence that a person intended to sell or distribute illegal drugs:

  • Quantity of drugs: Possessing more illegal drugs than would be reasonably needed for personal use can indicate intent to sell. For example, having multiple ounces of cocaine may qualify, while having a small amount of marijuana may not.
