Megan’s Law Tier Classification Appeal

If you’re a registered sex offender in New Jersey, you know that Megan’s Law requires public notification about your offense. But what you may not realize is that you have the right to appeal your classification tier if you believe it’s too high.

In this article, I’ll explain how the Megan’s Law tier system works, what your options are if you want to challenge your tier level, and why working with an experienced sex crimes lawyer is so critical for the appeals process. Megan’s Law Tier Classifications in New Jersey

Under New Jersey’s Megan’s Law, registered sex offenders are categorized into three tier levels based on the offense committed:

  • Tier 1 – Low risk of re-offense. Usually involves non-violent crimes.
  • Tier 2 – Moderate risk of re-offense. Often includes sexual contact crimes.
  • Tier 3 – High risk of re-offense. Normally includes violent sexual crimes.

The tier classification process begins after conviction or release from custody. You’ll be assessed using the Regulatory Regime Assessment Scale (RRAS) to calculate a score based on the offense and your criminal history. The total RRAS score determines your tier level.

Higher tier levels mean more public notification requirements. Tier 1 only requires notification to law enforcement. But Tier 2 involves schools, community groups, and neighbors being notified. And Tier 3 means the public registry website and widespread community alerts.

How to Appeal Your Megan’s Law Tier Classification in NJ

If you believe your tier classification is too high under the RRAS scoring, you have the right to challenge it. Here is the appeals process in New Jersey:

  1. The prosecutor makes an initial tier recommendation based on your RRAS score.
  2. Before sentencing, your defense lawyer contests the tier level if too high.
  3. The judge decides the final tier classification to be imposed.
  4. If you still disagree, you can file an appeal through the courts.
