Whistleblower Rewards Programs for Reporting Fraud

Hey there! If you’ve ever seen or suspected fraud and wanted to report it, but weren’t sure how to go about it, you’ve come to the right place. This article will give you the lowdown on whistleblower rewards programs that exist for reporting fraud.
I’ll walk you through the different laws and programs out there, how they work, the protections for whistleblowers, and the potential rewards you could get. My goal is to make this info easy to understand and empower you to make that call if you see sketchy stuff happening. Fraud hurts everyone, so blowing the whistle is a courageous thing to do.

What is a Whistleblower?

First things first – what exactly is a whistleblower? A whistleblower is someone who reports misconduct, fraud, or illegal activity they see occurring in a business, government agency, or other organization.
Whistleblowers play a crucial role in exposing corruption, fraud, threats to public health and safety, and other wrongdoing that organizations might try to hide. Their insider knowledge helps bring these misdeeds to light so problems can be fixed.
Some famous whistleblower cases you might have heard about:
The Ukraine whistleblower whose 2019 complaint led to Trump’s first impeachment
Jeffrey Wigand, the tobacco company executive who exposed Big Tobacco’s lies about nicotine addiction
Sherron Watkins of Enron, who tried to blow the whistle on the company’s massive accounting fraud
Gretchen Carlson, whose sexual harassment allegations led to Roger Ailes’ downfall at Fox News
So in short, whistleblowers are people who take a stand when they see something unethical happening behind the scenes. They’re everyday heroes who decide to put integrity above self-interest.

Protections for Whistleblowers

I know you might be worried about possible retaliation if you blow the whistle. Believe me, that’s understandable! Most whistleblower laws have safeguards built in to protect you from retaliation.
For instance, under the federal Whistleblower Protection Act, it’s illegal for your employer to fire you, demote you, harass you, or take other retaliatory actions because you reported wrongdoing. If they do retaliate, you can file a complaint with the Department of Labor or take them to court.
Other whistleblower reward programs have similar protections too. The idea is to remove any disincentives for people to speak up about misconduct they discover.
That said, every situation is different and there are no guarantees. Make sure you consult with an attorney to understand exactly what protections may cover you if you decide to blow the whistle. Most whistleblower lawyers offer free consultations.

Whistleblower Rewards Programs

Alright, let’s dive into the good stuff – the actual whistleblower rewards programs out there! Here are some of the main laws and programs that you should know about:
False Claims Act
The False Claims Act is one of the biggest whistleblower reward programs out there. It covers fraud against the federal government, like overbilling Medicare/Medicaid, defense contractor fraud, underpaying royalties for drilling on federal land, etc.
Under the False Claims Act, if your whistleblower tip leads to the government recovering money, you could get an award of 15-30% of the total amount recovered. For tips leading to smaller recoveries under $1 million, the award percentage may be lower, but can still be up to 25%.
Some of the largest whistleblower rewards have been issued under the False Claims Act. For instance, a GlaxoSmithKline whistleblower received $96 million for exposing fraudulent drug marketing!
SEC Whistleblower Program
If you discover securities fraud or violations of SEC rules, you can report it to the SEC Whistleblower Office and potentially earn a big reward.
This program issues awards to whistleblowers whose original information leads to SEC enforcement actions with total monetary sanctions over $1 million. The award amount can range from 10-30% of the money collected.
Some examples of SEC whistleblower awards:
An anonymous whistleblower got over $28 million for reporting widespread investment scheme misconduct.
Two whistleblowers split an award of over $40 million for reporting securities violations by a major financial institution.
The SEC Whistleblower Program also allows you to submit tips anonymously if you wish.
IRS Whistleblower Program
If you know about tax fraud or people evading taxes, this one’s for you. Under the IRS Whistleblower Program, you can report tax law violations and potentially earn 15-30% of the taxes, penalties, and interest the IRS collects based on your information.
Recent examples:
An accountant whistleblower received over $18 million for reporting large-scale tax underpayments by a Fortune 500 company.
A whistleblower tip led to the IRS recovering $20 million in employment taxes, resulting in a $3.6 million reward for the whistleblower.
The IRS Whistleblower Office will protect your identity as an informant to the fullest extent permitted by law too.
CFTC Whistleblower Program
Got a hot tip about misconduct in the commodities or futures markets? The CFTC Whistleblower Program rewards eligible whistleblowers whose tips lead to enforcement actions over $1 million with 10-30% of the monetary sanctions collected.
Recent examples of CFTC whistleblower awards:
A whistleblower received over $200 million – the largest award ever by the CFTC – for reporting manipulative and deceptive schemes by JPMorgan traders.
Another whistleblower got a $500,000 award for reporting false statements made to the CFTC during an investigation.
State False Claims Acts
Around 30 states and DC have their own False Claims Acts that allow whistleblowers to report fraud against state programs or agencies. The whistleblower award percentages are similar to the federal False Claims Act – generally 15-30% of the recovery.
For instance, a California whistleblower received over $9 million for exposing kickbacks and false claims submitted to Medi-Cal.
And a Walgreens whistleblower got a $1.4 million reward for reporting fraud in overbilling state Medicaid programs.
Other Whistleblower Laws
There are also whistleblower reward programs covering specific industries or types of fraud:
The FDA whistleblower program rewards tips about defective medical products, tainted food/drugs, etc.
The Department of Transportation rewards airline safety whistleblowers.
The Department of Defense rewards whistleblowers who report defense contractor fraud.
As you can see, there are lots of laws out there encouraging whistleblowers to come forward! The hard part is understanding which program applies to your situation.

How to File for a Whistleblower Reward

If you think you may qualify for a whistleblower reward, make sure you follow the proper procedures:
Hire an experienced whistleblower attorney – they can help you navigate the process and maximize your reward.
File a whistleblower complaint with the appropriate government agency. There are strict deadlines so don’t delay!
If you submit your tip to the SEC, CFTC, IRS, or other agencies with whistleblower programs, make sure to declare in writing that you want to be considered for an award.
Cooperate fully with the government’s investigation by providing all evidence you have, answering questions, etc. Ongoing assistance helps increase your reward percentage.
Follow your attorney’s advice to avoid accidentally disclosing your whistleblower status, tipping off the wrongdoers, or violating confidentiality rules that could hurt your case.
It can take years for a whistleblower case to resolve and for you to get your reward. Patience and perseverance will pay off in the end!

The Bottom Line

Blowing the whistle is a big step, but also a chance to do the right thing. You could help stop fraud, protect innocent victims, and earn a nice financial reward in the process.
Hopefully this article gave you a better understanding of the whistleblower landscape and how these programs work. Now that you know your options, you can make an informed decision if you ever come across misconduct in the future. We need more everyday heroes who are willing to speak truth to power!
Let me know if you have any other questions. I’m always happy to chat more and point you in the right direction. Wishing you the courage to act on your conscience if the need arises. Never doubt that you can make a difference!
