What is a CPL 440.10 Motion?

A CPL 440.10 motion is a legal thing you can file in New York to try to vacate (cancel) a criminal conviction. CPL stands for “Criminal Procedure Law” and 440.10 is the section in that law that lets you file this motion.Basically, its a way to challenge your conviction and try to get a new trial or sentencing. You file it with the court that originally handled your criminal case. The motion argues that there were legal problems with your case that make your conviction unfair.So how’s it work? Here’s a quick rundown of this CPL 440.10 thing:

When Can You File It?

  • You can file a 440.10 motion any time after you get convicted and sentenced. There’s no deadline or time limit.
  • But don’t wait too long! The court might not look kindly on you if you wait years to bring up issues.
  • Best to file as soon as you can after conviction. That way if the 440 is denied, you can also raise issues on direct appeal.

What Makes a 440.10 Motion Different From a Direct Appeal?

  • Direct appeal deals with stuff that’s already in the trial record – what happened at trial, plea hearing, etc.
  • 440 motion brings up stuff that’s NOT in the record – things outside of court proceedings.
  • So 440 motion allows you to bring new facts and issues to the court’s attention.

What Kinds of Issues Can a 440 Raise?

There’s a bunch of different legal and factual arguments you can make with a 440 motion. Some big ones:

  • Constitutional violations – your rights under the U.S. or NY constitution were violated.
  • Ineffective assistance of counsel – your lawyer screwed up big time.
  • Suppression of evidence – prosecutors hid evidence that would have helped you.
  • New evidence – you found new evidence that could change the verdict.
  • Lack of jurisdiction – the court wasn’t allowed to hear your case.
  • Invalid/excessive sentence – your sentence was illegal or too harsh.

Basically any legal or factual problem with your case that’s outside the trial record. As long as you meet the filing requirements (more on that next), the court has to consider the motion.

What Are the Filing Requirements?

There’s some hoops you gotta jump thru to file a 440.10 motion:

  • Has to be in writing, with numbered paragraphs and sworn statements.
  • Need affidavits from people with personal knowledge of your claims.
  • Must state exactly what legal and factual issues you’re claiming.
  • Can’t just duplicate stuff already in trial record or prior appeals.
  • If based on new evidence, has to meet various standards for new trials.

It’s not easy – the courts won’t just take your word for it. You need strong proof to back up your arguments. So it’s really important to work with a lawyer who knows how to file a convincing 440 motion.

What Happens After You File?

The DA’s office can submit papers opposing your motion. The court reviews everything and decides whether to hold a hearing.If the court finds your motion meets the requirements and raises legit issues, it’ll hold a hearing where you can present evidence and call witnesses.
