Everything You Need to Know About Warrant Searches in Las Vegas

What is a Search Warrant?

A search warrant is a legal document issued by a judge that allows police to enter a home or business and search for specific items related to a crime. The warrant will describe what the police are looking for and where they can search.
For example, if the police suspect someone of dealing drugs out of their home, they may get a warrant to search that person’s house for drugs, drug paraphernalia, cash, and records of drug transactions. The warrant gives them legal permission to go into the home, even without the owner’s consent, to look for those specific things.

When Can Police Get a Search Warrant in Las Vegas?

For the police to get a search warrant in Las Vegas, they have to show probable cause to a judge. This means they have to provide evidence that gives them good reason to believe:

  • A crime has been committed or is being committed
  • Evidence of that crime exists
  • That evidence is located in the place they want to search

This evidence can include witness statements, surveillance footage, anonymous tips that have been corroborated, drug dog alerts, and more. If the judge agrees there’s probable cause, they’ll issue a search warrant.
Police don’t need a warrant if they have consent to search or if there are special circumstances like emergency aid or hot pursuit of a fleeing suspect. But in most cases, Las Vegas police need to get a judge’s approval before searching private property.

How Las Vegas Warrant Searches Are Conducted

Once police obtain a Las Vegas search warrant, they can execute it anytime day or night (but usually between 6 AM and 10 PM). They don’t have to give the home or business owner any warning before showing up.
When police serve the warrant, they’ll knock and announce themselves, saying they have a search warrant. If no one answers within a reasonable time, the officers can force entry.
The warrant gives police authority to search any areas and containers described in the warrant and seize any relevant items as evidence. That may include drawers, closets, safes, locked containers, vehicles on the property, and more.
Generally the owner or occupant doesn’t have to consent or even be present for the search. Anyone at the scene can be detained during the warrant search as well. The warrant overrides a person’s normal Fourth Amendment rights while it’s being executed.
Police searches can be invasive, causing damage to property in some cases. But ultimately, the police are responsible for conducting themselves professionally and limiting the search to what’s necessary to find the items listed in the warrant.

Can You Get Evidence Thrown Out After a Las Vegas Search?

If Las Vegas police violate your rights while conducting a warrant search, any evidence found may be suppressed (thrown out) in court under the exclusionary rule. This happens primarily when:

  • The search warrant contained false or misleading information
  • Police exceeded the scope of the warrant
  • Evidence was mishandled after being seized

An experienced criminal defense lawyer can review the warrant paperwork and police reports to check for defects. If any issues can be proven, the lawyer can file a suppression motion asking the judge to exclude that evidence from the case.
Getting damning evidence thrown out often leads to charges being dismissed. So it’s important to closely scrutinize the warrant and make sure police executed it properly.

When Can Police Search Without a Warrant in Las Vegas?

While warrants are required in most cases, Las Vegas police can legally search without one if:

  • They have voluntary consent from the property owner
  • Evidence is in plain view from a lawful vantage point
  • Exigent circumstances exist – destruction of evidence concerns, emergency aid needed, hot pursuit of a fleeing suspect
  • The search is incident to a lawful arrest and limited to the arrestee’s area of immediate control
  • Police are conducting a protective sweep to check for dangerous individuals on the premises
  • Police have reasonable suspicion of criminal activity when conducting a lawful traffic stop or investigative detention
  • The search takes place at the U.S. border or “border equivalent” like an international airport

Searches in any of those circumstances don’t require a warrant under the Fourth Amendment. But without a warrant, the police’s authority is much more limited. And failure to meet one of the exceptions means the search was illegal.
