Dealing With Subpoenas from Federal Agencies

Subpoenas can be scary. You get this official letter demanding you hand over documents or testify about something. It’s coming from a powerful government agency like the Department of Justice or the EPA. What do you do? Don’t panic! I’m going to walk you through how federal agencies issue subpoenas, your rights and protections, and some tips for handling them.

What Exactly is a Subpoena?

A subpoena is a written legal order requiring you to provide documents, give testimony, or both to support some kind of investigation the agency is conducting.There are two kinds:

  • Subpoena ad testificandum – This says you have to testify in person or at a deposition.
  • Subpoena duces tecum – This one demands you hand over documents or physical evidence.

These subpoenas are serious business. Agencies can issue them because specific laws give them that power. For instance, the DOJ can subpoena people or companies under the Inspector General Act, the Controlled Substances Act, and other laws.

Limits on Subpoenas

Now, federal agencies can’t just subpoena whoever they want whenever they want. There are some legal limits so they don’t abuse their power:

  • The subpoena has to be for a legitimate purpose related to the agency’s duties. They can’t just subpoena your company on a whim.
  • The information requested has to be relevant and important to an actual investigation. They can’t go on a “fishing expedition” with a subpoena.
  • Subpoenas can’t be used just to harass or intimidate people. There has to be a valid reason.
  • Agencies have to follow their own rules and procedures about issuing subpoenas.
  • Subpoenas to journalists or news companies get extra scrutiny. They have to be approved by the Attorney General.
  • Subpoenas also can’t violate your Constitutional rights against unreasonable search and seizure.

Bottom line – there are guardrails here to prevent government agencies from going hog wild with subpoenas.

Getting a Court to Enforce the Subpoena

Now let’s say you get a subpoena but you refuse to comply. The agency can’t just punish you on the spot. Here’s what happens:The agency has to go to federal court and get a judge to issue an order enforcing the subpoena. This means a neutral third party is making sure the subpoena is legal and valid.For the judge to enforce it, the agency has to show:

  • There’s a legitimate investigation underway
  • The information requested is relevant
  • The subpoena isn’t too vague or broad
  • Complying won’t be unreasonably burdensome

If the court agrees, then you have to comply. If you still refuse at that point, you could face civil or criminal contempt charges.

Your Rights and Protections

If you’re on the receiving end of an agency subpoena, you have rights:

  • Right to object – You can challenge the subpoena by filing a motion to quash with the court.
  • Right to legal counsel – Get a lawyer to help you respond.
  • Reasonable time to respond – Courts will make sure you have enough time to gather everything.
  • Reimbursement for costs – You can request reimbursement for travel, copying, etc.
  • Limits on scope – You can object if the subpoena asks for too much irrelevant stuff.
  • Privacy protections – Agencies have to protect any private info they get from you.

So don’t just roll over! Make sure to assert your rights. A good lawyer can help with that.

Tips for Responding

OK, so you just got a subpoena from the EPA or some other federal agency. Here are some tips:

  • Don’t ignore it! You have to respond even if you plan to object.
  • Read it carefully so you understand what they’re asking for.
  • Note any deadlines and make sure you meet them. Courts don’t give second chances.
  • Consider your options – comply, negotiate, file an objection, motion to quash, etc.
  • Get a lawyer experienced with subpoenas to advise you.
  • Be careful about revealing any trade secrets or private information.
  • Preserve any documents requested while you decide what to do.
  • Stay calm and act professionally. Don’t get emotional.

Responding thoughtfully and getting good legal help can make all the difference. You can properly address the subpoena while protecting your rights and interests.I know getting a subpoena can be intimidating, but knowing your rights and following these tips will make it less scary.
