Philadelphia Federal Marijuana Charges: Trafficking and Distribution

Marijuana laws are complex, controversial, and rapidly evolving. In Philadelphia, federal marijuana charges for trafficking or distribution can lead to severe penalties – even when state laws have relaxed around cannabis use. This article breaks down key aspects of federal marijuana crimes, defenses, and recent precedents that shape how Philly cases play out.

Federal vs State Marijuana Laws – The Conflict

While over 30 states have legalized medical or recreational marijuana, it remains illegal at the federal level under the 1970 Controlled Substances Act. The federal government categorizes cannabis as a Schedule I drug with high abuse potential, no medical use, and severe trafficking penalties.

This conflict between state and federal law creates confusion. Growing or selling marijuana may be legal per Pennsylvania’s medical cannabis program — but the same activities can still be charged as federal felonies by the US Department of Justice.

Trafficking & Distribution Charges

Federal marijuana charges often relate to trafficking, distribution, or intent to sell the drug across state lines. Common federal cannabis crimes include:

  • Possession with Intent to Distribute
  • Interstate Trafficking
  • Drug Conspiracy
  • Maintaining a Drug-Involved Premises
  • Money Laundering

Penalties depend on the quantity of marijuana involved. For instance, possession over 50-100 kg has a 5 year mandatory minimum sentence. Trafficking 1000+ kg or earning over $1 million can trigger 10+ year sentences under federal sentencing guidelines.

Recent Philadelphia Federal Marijuana Cases

Philadelphia has seen increased federal marijuana prosecution, despite Pennsylvania’s medical cannabis program. Recent cases include:

  • 2020 – Dozens indicted in major Philly-California trafficking ring moving over a ton of pot and $22 million cash across the country.
  • 2021 – Local businessman charged with turning 9 Philadelphia properties into indoor grow facilities for interstate trafficking.
  • 2022 – Felony distribution charges against a medical dispensary owner accused of selling weed out-of-state.

The US Attorney’s Office in Philadelphia takes a hard line against gray market operators and those violating state medical laws. But federal law contains harsh mandatory minimums even for minor marijuana activities that are legal per state law.

Defenses in Philadelphia Federal Cases

Those facing federal marijuana charges have several defense options:

State Law Compliance – Arguing good faith efforts to comply with PA medical laws. However, this is often unsuccessful since federal law trumps state law under the Supremacy Clause.

Sentencing Mitigation – Seeking sentence reductions under 18 U.S.C. § 3553 by citing medical needs, addiction issues, age, family ties, employment history, or other mitigating factors.

Constitutional Challenges – Attacking the constitutionality of marijuana’s Schedule I status. For example, arguing medical benefits or lack of abuse potential relative to other legal drugs. While the Supreme Court has upheld federal marijuana law, some lower courts have pushed back.

Investigation Challenges – Contesting illegal searches, lack of probable cause, inaccurate informant testimony or other procedural issues with the investigation itself.

Plea Bargaining – Cooperating with prosecutors in exchange for lesser charges or sentencing recommendations. Over 90% of federal cases end in plea deals.

Case Dismissal – In rare cases, charges get dismissed over evidentiary issues, prosecutor misconduct allegations, or lack of Justice Department resources.

While challenging federal law directly remains difficult, experienced defense lawyers can often negotiate better outcomes in marijuana prosecutions using these strategies.

Looking Ahead

Despite recent federal enforcement efforts, Philadelphia marijuana policies seem headed towards greater tolerance. A 2019 FBI crime report showed over 5,300 cannabis arrests in the city — but only 34 federal cases that year.

The MORE Act recently passed the House and would end the federal marijuana prohibition, expunge records, and let states determine their own cannabis laws.
