In California criminal law, Penal Code 1203 PC deals with probation. Probation allows a defendant to avoid jail/prison time if they agree to abide by certain court-ordered terms and conditions.

What is Probation Under Penal Code 1203?

Penal Code 1203 PC defines probation as the suspension of a jail or prison sentence. Instead of incarceration, the court allows a convicted defendant to be released into the community under supervision.

  • It allows defendants to avoid serving a sentence as long as they follow set probationary terms
  • There are different types of probation depending on the offense
  • Probation has standard terms plus additional conditions based on the case
