Fighting Federal Tax Evasion Charges in New Jersey

26 U.S.C. Section 7201 is the well-known federal offense that strikes fear into the heart of individuals and businesses alike. It’s more simply known as tax evasion by the non-legal citizen, but anyone that’s ever paid taxes will tell you that this is one violation they never want to be charged with. It’s a criminal offense with steep penalties.

Reporting Taxes to the IRS

Citizens who earn money in the United States must report their taxes to the IRS each year. To do so, they must follow the rules and regulations set forth by the tax code in this country. NJ taxes are separate from federal taxes, but if you’re a NJ resident, you will reside in New Jersey when you’re charged with this federal crime. Federal tax evasion cases are investigated by the Criminal Investigations Division of the IRS. They consider tax evasion to fall under 7201. It states:

“Any person who willfully attempts in any manner to evade or defeat any tax imposed by this title or the payment thereof shall, in addition to other penalties provided by law, be guilty of a felony and, upon conviction thereof, shall be fined not more than $100,000, or imprisoned not more than 5 years, or both, together with the costs of prosecution.” Corporations can be fined up to $500,000.
