THE BEST LAWYER ANYONE COULD ASK FOR.

The BEST LAWYER ANYONE COULD ASK FOR!!! Todd changed our lives! He’s not JUST a lawyer representing us for a case. Todd and his office have become Family. When we entered his office in August of 2022, we entered with such anxiety, uncertainty, and so much stress. Honestly we were very lost. My husband and I felt alone. How could a lawyer who didn’t know us, know our family, know our background represents us, When this could change our lives for the next 5-7years that my husband was facing in Federal jail. By the time our free consultation was over with Todd, we left his office at ease. All our questions were answered and we had a sense of relief.

NJ Drug Distribution Charges and Penalties

Selling or distributing illegal drugs in New Jersey comes with stiff criminal penalties. NJ drug distribution laws are complex and include a wide range of charges based on the type and amount of drug involved. If you are facing charges for distributing drugs in NJ, it’s important to understand the specific laws and penalties you may be up against.

Drug Distribution vs. Possession with Intent to Distribute in NJ

New Jersey law distinguishes between actually selling or transferring drugs and merely possessing drugs with the intent to sell or distribute them. The criminal statutes for these two situations are:

  • NJSA 2C:35-5 – Manufacturing, distributing or dispensing drugs, or possessing drugs with intent to do so. This covers actual drug sales or transfers.
  • NJSA 2C:35-7 – Possessing drugs with intent to use, distribute, or manufacture. This covers possession of drugs without proof that sales or transfers occurred.

Prosecutors may initially charge defendants with drug distribution under 2C:35-5, then offer plea bargains down to 2C:35-7 possession with intent charges. But both carry severe penalties.

Penalties for Drug Distribution in New Jersey

Penalties for distributing illegal drugs depend on the type and amount of drug involved. Charges range from 3rd degree crimes to 1st degree crimes:

  • 3rd degree – 3-5 years in prison
  • 2nd degree – 5-10 years in prison
  • 1st degree – 10-20 years in prison

Fines up to $150,000 (2nd degree) to $300,000 (1st degree) may also apply. Even low-level marijuana distribution can be a 3rd degree felony with up to 5 years in prison.

Aggravating Factors for Drug Distribution Sentences

A few key factors can further aggravate sentences for NJ drug distribution:

  • School zones – Harsher penalties apply if drugs were distributed within 1,000 feet of a school.
  • Maintaining a drug production facility – Running an illegal drug production lab carries additional penalties.
  • Distributing to minors or pregnant women – These scenarios lead to longer sentences.

Defenses for Drug Distribution Charges in NJ

Despite the serious penalties, there are defenses that could get your drug distribution charges reduced or dismissed. Some potential defenses include:

  • You were not actually involved in distributing drugs
  • You did not possess the amount of drugs alleged
  • The police search was unlawful
  • The drugs were for personal use, not distribution
  • You were entrapped by police

An experienced criminal defense lawyer can evaluate the details of your case and advise you on the best defense strategy.

Finding a Lawyer for NJ Drug Distribution Charges

Never attempt to handle serious distribution charges on your own. An experienced drug crimes attorney can protect your rights in several key ways:

  • Evaluate any police misconduct regarding searches or questioning
  • Negotiate with prosecutors for reduced charges or diversion programs
  • Develop an effective defense strategy targeting weaknesses in the prosecution’s case
  • Represent you in court proceedings for the best possible outcome

Don’t leave your fate to chance. An experienced attorney could make all the difference in the outcome of your case. If you are facing drug distribution charges in NJ, contact a qualified lawyer immediately.
