Is Sexting Illegal? A Closer Look at the Laws

Sexting – the act of sending sexually explicit photos, videos, or messages via mobile devices – has become increasingly common, especially among teens and young adults. However, sexting raises complicated legal issues that many people fail to consider. Is consensual sexting between adults illegal? What about when minors are involved? Let’s take a closer look.

Consensual Sexting Between Adults

In most states, two consenting adults sexting each other privately does not break any laws. Since both parties are willingly participating without coercion, it is typically legal.

However, there are some exceptions to be aware of:

  • Revenge Porn Laws: It becomes illegal if one person shares intimate images of their partner publicly or online without the other’s consent. This constitutes revenge porn, which violates privacy rights.
  • Harassment/Stalking Laws: Repeatedly sending unsolicited, sexually explicit messages to someone could potentially violate stalking or harassment laws, even between adults.
  • Military Code of Conduct: Active duty military personnel can face penalties under the Uniform Code of Military Justice for conduct unbecoming of an officer for sexting.

So in most civilian contexts, consensual private sexting amongst adults is legal. But there are still risks like revenge porn, computer hacking, or accidental sharing that anyone engaging in sexting should consider.

Sexting Among Minors

Sexting takes on more legal significance when minors are involved. Child pornography laws prohibit any visual depictions of sexual conduct involving anyone under 18. So:

  • Minors can potentially face child porn charges for creating, sending, receiving, or even possessing sexually explicit images of themselves or other minors.
  • Adults can be charged with child porn crimes for sexting with minors or possessing nude photos minors created of themselves.

These child protection laws apply even if the sexting is:

  • Fully consensual
  • Between similar-age teens in a relationship
  • Never shared beyond the intended recipient

While some states have passed laws providing exceptions for consensual teen sexting, minors still risk strict child pornography charges in many jurisdictions.

Potential Legal Consequences

Depending on the specific circumstances, sexting – especially among minors – can lead to any of the following serious legal penalties:

  • Felony Child Pornography Charges: Anyone charged with producing, distributing, or possessing child pornography depicting minors under 18 faces felony charges punishable by years in prison and sex offender registration.
  • Sex Offender Status: Convictions for child porn sexting offenses often lead to mandatory sex offender registration that can follow people for life.
  • School/Job Loss: Teens face potential school discipline or expulsion if sexts spread through school. Adults sending sexts risk losing jobs and professional licenses over misconduct.
  • Civil Lawsuits: People whose intimate images get shared without consent may sue for invasion of privacy or emotional distress civil lawsuits.
  • Immigration Consequences: Any child porn or sex crime conviction can lead to deportation for non-citizen immigrants.

Protecting Yourself Legally When Sexting

  • Only Sext with Trusted Partners: Avoid impulsive sexts with casual acquaintances or strangers where you cannot control if images might be shared.
  • Use Apps with Encryption/Self-Destruct Features: Apps like Signal and Snapchat provide more control over image sharing with features like encrypted messaging or self-destructing images.
  • Crop Out Faces/Identifying Features: Removing identifying facial features from nude photos offers some protection against unwanted sharing.
  • Avoid Descriptions of Illegal Acts: Any messages describing underage or nonconsensual sexual activity are automatically illegal.
  • Delete Images When Received: Promptly deleting any intimate media received from others reduces illegal possession risks.
  • Consult a Lawyer If Charged: Anyone facing sexting investigations for child porn or other charges should immediately retain defense counsel. An attorney can argue the specific nuances around consent, age, intent, and other issues.
