The BEST LAWYER ANYONE COULD ASK FOR!!! Todd changed our lives! He’s not JUST a lawyer representing us for a case. Todd and his office have become Family. When we entered his office in August of 2022, we entered with such anxiety, uncertainty, and so much stress. Honestly we were very lost. My husband and I felt alone. How could a lawyer who didn’t know us, know our family, know our background represents us, When this could change our lives for the next 5-7years that my husband was facing in Federal jail. By the time our free consultation was over with Todd, we left his office at ease. All our questions were answered and we had a sense of relief.

Getting Legal Fees Dismissed for Ineffective Assistance of Counsel in NYC

Getting Legal Fees Dismissed for Ineffective Assistance of Counsel in NYC

If you feel like you didn’t get adequate legal representation during your case, you may be able to get your legal fees dismissed by claiming ineffective assistance of counsel. This article will explain what that means, when you can make that claim, and how to get those expensive legal fees dismissed in NYC.

What is Ineffective Assistance of Counsel

Ineffective assistance of counsel is when your lawyer didn’t properly defend you during your criminal or civil case. There are a few common ways this can happen:

  • Your lawyer didn’t fully investigate your case or prepare a strong defense
  • Your lawyer made serious mistakes during your trial or hearings
  • Your lawyer didn’t communicate well or give you good advice
  • Your lawyer had a conflict of interest or didn’t act in your best interests

If any of those things happened and you ended up with a bad outcome in your case as a result, you may be able to claim ineffective counsel. But you usually can’t claim this just because you lost – you have to show real mistakes or failures by your lawyer that hurt your case.

When Can You Make an Ineffective Counsel Claim in NYC

There are specific times when you’re allowed to claim ineffective assistance of counsel in NYC courts:

  1. Direct appeal after conviction – File a direct appeal based on ineffective counsel within 30 days after conviction.
  2. State post-conviction relief – File a 440 motion up to one year after conviction.
  3. Federal habeas corpus – File a habeas petition within one year of state conviction becoming final.
  4. Legal fee disputes – During a fee dispute in civil court, claim ineffective counsel as a defense.

The timing is very strict, so don’t wait too long if you want to make one of these claims! It’s best to contact a lawyer immediately if you think your defense was inadequate.

How to Get Legal Fees Dismissed for Ineffective Counsel

If your lawyer didn’t provide competent representation during your case, you shouldn’t have to pay them! Here is the process to get your legal fees dismissed in NY:

  1. Send a complaint letter – Write to the lawyer explaining how they failed you as counsel. Demand a refund of all fees paid.
  2. Negotiate a settlement – Many lawyers will try to settle these disputes out of court. Negotiate firmly to get fees dismissed.
  3. File a fee dispute – If no settlement, file a civil claim in NY Supreme Court for legal malpractice and fee dismissal.
  4. Present your case – You’ll have to prove ineffective assistance and that you deserve your money back. Use evidence of mistakes by the lawyer.

Having an experienced malpractice lawyer on your side can really help demonstrate where your defense lawyer fell short. Things like missing deadlines, not calling key witnesses, failing to suppress bad evidence, or not keeping you informed of case developments can all show ineffective counsel.

Judges in NY do not take these cases lightly, because they can impact a lawyer’s career. But if you present compelling evidence of incompetence or negligence, you have a good chance of recouping your legal expenses.

Should You Sue for More Than Just Fees

In some cases, the mistakes made by your lawyer may have caused additional damages beyond just legal fees. For example:

  • Lost wages from a job you couldn’t take while in jail
  • Loss of custody rights
  • Deportation or removal
  • Foreclosure on your home

If any outcomes like this happened because your lawyer was inadequate, you may want to sue them for additional compensation. This would be a professional negligence and malpractice lawsuit.

To succeed on a malpractice claim, you need to show:

  1. An attorney-client relationship existed
  2. The attorney was negligent in their duties
  3. You suffered damages as a direct result

These cases can be much more complex with detailed evidence and expert testimony. But if your damages are substantial, it may be worth pursuing compensation above just legal fee reimbursement.

Alternatives Besides Suing Your Lawyer

Suing your attorney for ineffective assistance or malpractice can be time-consuming and expensive. Here are a couple alternatives to consider first:

File a Grievance

Every state has a Bar Association that oversees complaints about lawyers. In NY, you can file a written complaint for misconduct with evidence. If found guilty, the lawyer may be disciplined, fined, or disbarred.

Change Lawyers

If it’s not too late, you may still be able to change lawyers and get competent representation. This is easier in civil cases than criminal ones. Getting a skilled new lawyer can help fix any damage done and get you back on track.

Suing an attorney is always tough and nothing is guaranteed. But if inadequate legal counsel resulted in unfair outcomes or financial harm, you deserve justice!

Hopefully this gives you a better understanding of how to potentially get legal fees dismissed due to ineffective assistance in NYC. Let me know if you have any other questions!
