The BEST LAWYER ANYONE COULD ASK FOR!!! Todd changed our lives! He’s not JUST a lawyer representing us for a case. Todd and his office have become Family. When we entered his office in August of 2022, we entered with such anxiety, uncertainty, and so much stress. Honestly we were very lost. My husband and I felt alone. How could a lawyer who didn’t know us, know our family, know our background represents us, When this could change our lives for the next 5-7years that my husband was facing in Federal jail. By the time our free consultation was over with Todd, we left his office at ease. All our questions were answered and we had a sense of relief.

Fighting Allegations of Fraudulent Postage Refund Schemes

Fighting Allegations of Fraudulent Postage Refund Schemes

Getting accused of postal fraud can be scary. The penalties are severe, and the allegations can ruin your reputation. But with the right approach, you can fight the charges and protect yourself.

The first step is to stay calm. Easier said than done, I know! But getting emotional or panicking will only make things worse. Take a few deep breaths and focus on getting through this one step at a time.

Understand the Allegations

Before you can defend yourself, you need to understand exactly what you’re being accused of. The authorities should provide details on the specific allegations and the evidence they have. Make sure you get as much information as possible.

Some common postal fraud schemes include:

  • Filing false refund claims for postage or services
  • Using counterfeit stamps or postage meter imprints
  • Stealing mail to obtain checks, money orders, credit cards, or personal information
  • Misrepresenting mailing costs to overcharge customers

Knowing the specifics will help you figure out the best defense strategy. For example, if you’re accused of using fake stamps, you’ll want to focus on proving the authenticity of your stamps.

Gather Any Evidence You Have

To fight the charges, you need evidence on your side too. Gather up any documents, records, or other information that could help prove your innocence. This might include:

  • Valid receipts for stamp purchases
  • Accounting records showing postage expenses
  • USPS records verifying your refund claims
  • Testimony from credible witnesses

Even things like photos or videos showing you mailing packages with proper postage could be useful. The more evidence the better, so look through your records thoroughly.

Get Legal Representation

Facing allegations of postal fraud is not something you should handle alone. These cases can be complex, and the stakes are high. Having an experienced attorney on your side is critical.

Look for a lawyer who specializes in criminal defense and, even better, one who has specifically handled postal fraud cases. Understandably, legal fees can be a concern. But an attorney may help get charges reduced or even dismissed, so it’s worth the investment.

A lawyer can also serve as your representative if you need to negotiate with investigators or prosecutors. Having a legal expert argue your case makes the process less intimidating.

Cooperate Fully with the Investigation

Once you have legal counsel, follow their advice about cooperating with the investigation. In most cases, being open and transparent is the best approach. Avoid any temptation to hide information or obstruct the inquiry in any way.

You have the right to decline interviews or other questioning until your attorney is present. But otherwise, provide honest answers and turn over relevant records if requested. Making investigators dig for facts themselves risks raising more suspicions.

That said, do not volunteer any unnecessary information. Stick to directly answering the specific questions asked. Your attorney can help guide you on where to draw the line.

Consider Alternative Resolution Options

Rather than go to trial, your attorney may advise resolving the case through:

  • Plea Bargain: Plead guilty to lesser charges in exchange for reduced penalties.
  • Pre-trial Diversion: Agree to fulfill certain conditions like restitution payments, and charges will be dropped.
  • Mediation: Work with prosecutors to negotiate an agreeable settlement.

These options still require admitting some guilt but let you avoid harsher consequences of a conviction. Your lawyer can pursue negotiations and give their assessment on the best route for resolution.

Prepare Your Defense Strategy for Trial

If settlement talks fail and your case goes to trial, being ready with a defense strategy is crucial. Your attorney will lead this effort, but potential angles to explore include:

  • Attack the evidence: Identify holes or inconsistencies that create reasonable doubt.
  • Highlight your cooperation: Emphasize that you voluntarily provided information and records.
  • Note lack of criminal history: Argue the charges are out of character for you.
  • Suggest an alternate theory: Provide other plausible explanations for the allegations.

Having character witnesses vouch for your honesty and integrity can also be persuasive. Your lawyer will craft the strongest defense using the evidence and strategies most likely to instill doubt.

Consider Your Options Carefully

If convicted, you could face fines, probation, and even jail time. The consequences can be severe. So carefully weigh your options throughout the process.

Accepting a plea deal or other early resolution may feel like admitting defeat. But it may be the smartest way to move forward if the evidence is stacked against you. A skilled attorney can provide clear-eyed advice on the best path forward.

Don’t Lose Hope

Dealing with allegations of postal fraud can be overwhelming. But stay positive and keep fighting. With an experienced legal team guiding you, it is possible to successfully defend yourself, protect your reputation, and avoid harsh penalties. You’ve got this!

If you have any other questions on fighting postal fraud charges, I’m happy to help however I can. Wishing you the very best as you work through this challenging situation.
