What is Domestic Battery? A Breakdown of This Serious Offense

Domestic battery refers to a specific type of battery offense committed against a family or household member. It’s considered more serious than regular battery charges due to the close relationship between the perpetrator and victim.But what exactly constitutes domestic battery? And how is it different from domestic violence or assault charges? Let’s break it down.

Defining Domestic Battery

In most states, domestic battery involves intentionally and unlawfully using force or violence against a family or household member without their consent. This includes things like:

  • Hitting, punching, slapping, kicking
  • Pushing, grabbing, restraining
  • Strangling or choking
  • Offensive touching of any kind

Unlike regular battery, the victim must be a family or household member for it to qualify as domestic battery.

Who Qualifies as a Family or Household Member?

The definition of “family or household member” is fairly broad under domestic violence laws. It typically covers:

  • Spouses and former spouses
  • Current or former dating partners
  • Parents, children, siblings
  • In-laws
  • Anyone related by blood or marriage
  • Roommates or cohabitants

So even if you don’t have one of the above formal relationships, cohabiting with someone is enough to meet the relationship requirement.

Domestic Battery vs. Domestic Violence

While the terms “domestic battery” and “domestic violence” are sometimes used interchangeably, they refer to slightly different things legally speaking:

  • Domestic battery specifically refers to the physical act of violence against a family or household member.
  • Domestic violence is a broader umbrella term that covers any threatening behavior, harassment, physical abuse, or other abusive behavior perpetrated by one family or household member against another.

So all domestic battery constitutes domestic violence, but not all domestic violence meets the criteria for domestic battery charges.

What About Domestic Assault?

In contrast to battery, domestic assault refers to threats of violence rather than actual physical violence. To qualify as domestic assault, the perpetrator must:

  • Threaten to physically harm a family or household member
  • Have the apparent ability to cause harm
  • Reasonably put the victim in fear of imminent harm

So verbal threats alone don’t always constitute domestic assault unless the perpetrator demonstrates a real ability and intent to cause harm.

Penalties for Domestic Battery Convictions

Since domestic battery is considered more serious than regular battery, the potential penalties are heightened. Exact statutes and sentencing ranges vary by state, but possible penalties generally include:

  • Up to 1+ years in jail or prison
  • Thousands in fines
  • Probation or parole
  • Batterer intervention programs
  • Restraining orders

In particularly serious cases involving strangulation, dangerous weapons, or severe injuries, domestic battery may be charged as a felony. This carries steeper prison times up to 15+ years in some states.

Common Defenses Against Domestic Battery Charges

False allegations
