Challenging Forced Confessions Made Without a Lawyer in NYC

Being interrogated by the police can be an intimidating and stressful experience. Many people may feel pressured to confess to crimes they didn’t commit. This is especially true if they are questioned without a lawyer present to advise them of their rights. Unfortunately, false and coerced confessions happen more often than many realize.

In New York City, there have been several high-profile cases of false confessions leading to wrongful convictions over the past few decades. In 1989, five teenage boys (known as the Central Park Five) were coerced into giving false video confessions after lengthy police interrogations without lawyers. They spent years in prison before being exonerated in 2002 when the real perpetrator confessed and DNA evidence cleared them.

More recently, Huwe Burton was exonerated in 2021 after spending nearly 20 years in prison. He had falsely confessed when detectives lied and told him he failed a lie detector test. Numerous other cases of false confessions have happened in NYC as well.

The good news is that New York law provides some safeguards against false confessions. Suspects have a right to remain silent and not answer police questions. They also have a right to ask for a lawyer before and during any police interrogation.

Here are some key things to understand about challenging confessions in NYC:

  • Police are allowed to lie and use deceptive tactics during interrogations. This can coerce innocent people into confessing.
  • Juveniles and people with mental disabilities are especially vulnerable to giving false confessions.
