Carnal Knowledge of a Minor in Florida: Statutory Rape Laws, Penalties and Defense

Statutory rape laws in Florida make it illegal for an adult to have sex with a minor under the age of 18, even if the minor consents to the sexual activity. These laws are meant to protect minors from being taken advantage of by older, more experienced adults. But they can also lead to serious criminal charges for 18-24 year olds who have relationships with teens who are close in age.

I want to walk through Florida’s statutory rape laws and penalties, look at some real-world examples, and talk about potential defenses. My goal here is to educate people on this complex issue in a conversational way, using plain language a high schooler could understand. What is Statutory Rape in Florida?

Florida’s age of consent is 18. That means anyone under 18 cannot legally consent to sex. If you’re over 18 and have sex with someone under 18, you are commiting statutory rape under Florida Statute 794.05. There are a few exceptions:

  • 16 and 17 year olds can consent to sex with someone between the ages of 16-24
  • Minors can petition the court to be granted the rights of an adult, removing the age restrictions

Outside of those exceptions, anyone 24 or older who has sex with someone 16-17 commits a 2nd degree felony. If the minor is under 16, it becomes an even more serious 1st degree felony with harsher penalties.

The other key thing about statutory rape is that consent does not matter. Even if the minor agrees to or initiates sex, and the adult had no idea they were underage, it is still a crime.

Penalties for Statutory Rape in Florida

Statutory rape charges come with severe penalties in Florida:

  • Up to 15 years in prison for a 2nd degree felony
  • Up to 30 years for a 1st degree felony
  • Large fines, often $10,000 or more
  • Mandatory sex offender registration
  • Probation and community service

These penalties can completely derail someone’s life – even for consensual relationships between teens and young adults. Many argue the laws go too far and should be reformed to avoid overly harsh punishments.

Real World Examples

Here are some real cases that show how Florida’s statutory rape laws are applied:

  • An 18 year old high school senior was charged with a felony for having sex with his 15 year old girlfriend. He faced 5 years in prison despite the relationship being consensual.
  • A 21 year old had sex with a girl he met at a club who claimed she was 19. She was really 16. He was convicted and labeled a sex offender.
  • A 19 year old was arrested for dating a 14 year old he met online who lied about her age. He was sentenced to 3 years in prison.

While some of these situations seem unjust, the courts have repeatedly upheld strict statutory rape laws – even when the minor lies about their age or consents to sex. Ignorance of age is never a defense.

Possible Defenses

Fighting statutory rape charges in Florida is very difficult given the strict liability nature of the law. But some potential defenses include:

  • You and the victim are close in age – the Romeo and Juliet law may apply
  • The alleged victim is not being truthful about their age or consent
  • You were falsely accused out of anger, jealousy or manipulation
  • The sexual contact did not actually occur

  • Avoid minors on dating sites – stick to verified adults
  • Don’t rely only on appearance – demand ID to confirm age
