California Penal Code Section 401 PC: Aid, Advise or Encourage a Suicide

California Penal Code Section 401 PC makes it a crime to assist, advise, or encourage someone to commit suicide. While there are differing opinions about the morality of assisted suicide, aiding, advising, or encouraging a suicide is considered a felony in California – even if the other person survives the suicide attempt.

The End of Life Option Act

  • The patient must make two oral requests (15 days apart) and one written request to their attending physician.
  • The patient must be diagnosed with a terminal illness with a prognosis of six months or less to live.
